Hello Everyone,

Can anyone comment on this, I came to India on vacation and due to personal problems had to stay for 4 months around 3 1/2 months now and 20 days earlier which makes my stay this year to around 4 months after my GC approval in Feb this year, can this pose any problem for me when coming back to U.S at P.O.E, as I have heard that one should not stay for more than 6 months outside U.S after GC approval.

I will be travelling back to US next week or so?

Please give your inputs as soon as possible.

where on earth does it say that a GC holder cannot stay outside US for more than 6 months ?? As long as its less than a YR , its fine...If needed for more than a yr, then Reentry permit needs to be applied..

All that 6 months thing does is break the continuty for citizen ship process but that is a total seperate issue..

I think i might be wrong here but i read from the link below that to Keep Your Immigration Status

"LPRs who leave the United States for extended periods, or who cannot show their intent to live permanently in the U.S., may lose their LPR status. If you think you will be out of the U.S. for a long period of time (more than 6 months), before leaving the country you should:

File Form I-131, Application for a Travel Document,
to apply for a re-entry permit. A re-entry permit is
valid for up to 2 years and is proof that you are returning
from a temporary visit abroad.You may show
the re-entry permit at a port of entry instead of a
returning resident visa or a Permanent Resident Card."
