I just recently joined this forum and I have been reading some of the archives and I have learnt a lot.
However, since every situation is different, I was wondering if someone can let me know what is my best option with my situation.
I received my Bachelor's degree from US in May 2003 and joined as a full time employee in September 2001. My company applied for my H1B in April 2004 and I received my H1B approval in 15 days. However, since my OPT period ended in June 2004, and I could legally stay for 2 more months after that period, I left US on 14th August and went back to India. I got my H1B stamped and came back to US on 2nd October 2004, the day my H1B started.
Since my company was not too keen on sponsoring me for Green card unless I worked for 4 years, I just changed my company after working for 2 years and joined a consulting company. I got a 1 year project at a big financial company and I am working there now.
In addition, I am starting my part time masters in September of this year which should finish in 2007 end.
My company is willing to sponsor my Green card though I havn't still gotten in touch with the lawyer. My questions, if someone can help me with:
1. Do I belong to EB3 or EB2 category? ( I personally think EB3)
2. If I apply for my Labor on September 1st, 2005, what is the realistic time frame when I can get my labor?
3. Can I use a pre approved labor of another individual in the same category if my company has a pre approved labor with it?
4. If I get my labor cleared, how long does it take for I-140 processing? And how long does it take for I-485 process?
Realistically speaking, if I take September 2005 as the starting date, when can I reasonably expect to get my green card?
I would appreciate if someone can help me with this and if they have any recommendations or suggestions about how I should proceed with things from now on, I would be very grateful.
