I joined a company called X and applied for H1B transfer in July 2002. As this was in process, I found another employer Y who had an approved labor and willing to file I-140 directly. So, I joined Y in December and applied for H1B again using the receipt of H1B which was in process as it wasn't approved yet. Now, the first H1B got approved but INS has denied the extension of stay.
1) Can I still stay in this country as my new H1B is in process?
2) I want to file I-140 with Y. Compnay Y asking for all H1B s that I had before to file 140. If I include the H1B from X on which extension of the stay is denied, will it cause any problem for the approval of 140?
3) If it causes any problem, can I just include the H1B receipt to get away with that?
3) Will I have any problem for approval of 485 because of this?
