Sue the USCIS or not? Please help.

Here is my case details:

Filed my case VSC, DO is Hartford

PD 03/31/2006
Interview : 08/21/2006
Sent requested N-14 info on Mar 1st. Tax documents and rental lease was sent.

During Interview I got a letter stating that I passed my english and civics test and they will mail me N-14.

Now the question is, Can suing help my case? I am tired of waiting and not able to do anything in my personal life.

Try to engage you senators and representatives. They may be of some help. If that fails sue USCIS.
 
SUE them if you're so impatient, otherwise do nothing since Senator will query USCIS and you'll get same exact answer as Info Pass.
The only route to skip USCIS and some how got an answer from FBI is to ask Laura Bush for help. Looks like in such situation your letter will be forwarded to DHS and then to NNCP. At least some guys claimed that.
 
Actually, if it's not a name check issue (where everyone throws up there hands and says "there's nothing we can do"), you can get something from your local representative or the local immigration aid in your senator's office - I did.

Writing letters to the district office director (at least in my experience (in Dallas)) seems to be a complete waste of time. I sent two letters asking what happened to my application and to my file - when I eventually saw my file, I found out what happened to my letters - they got stuck in there.

So far, the Dallas director is 3 for 3 in ignoring my letters (though the 3rd one is only a week or two old at the moment).

I think mine is not name check issue. It is stuck in some burecratic way this specific IO is checking at Hartford. Can I sue, even if my case is not stuck in name check?

Yes, if you are 120 days after the interview. However, try the congressman/senator route first.

I contacted my congressman sometime back, his office just checked the status and got back to me saying my case is pending.

Other than checking status, what else a congressman/Senator can do?

You are true. My case is also over 120 days, to be exact 125 days after the interview, I contacted the congressman's office, they got back to me with the same info as infopass that they have to consolidate files, it may take upto 240 days. I rewrote to them asking can they do something to speed up the process? I also contacted my senator in meanwhile, this seems to be bit professional like they asked me to write a letter and sign a paper and fax it to them. I did. I am waiting for the reply.
 
They can't do anything other than check status for name check problems. As a result, they tend to think that they can't do anything.

My interview was descheduled last year. The problem that caused the descheduling was resolved less than a month later. But, the USCIS put me into a "we'll handle these cases later" pile and my application floundered.

I contact my congressman's local office. A week or two later I was told my exact status, but that there wasn't anything that they could do, that "thousands" of applicants were in front of me. Since my PD was nearly a year old, my file had been at the local DO for two months and there were no other problems, I knew that there shouldn't be "thousands" of people in front of me.

So I contact the local (Dallas) office of one of my senators. I sent the forms in, and, after 2 weeks had passed phoned her up. Rather than "complaining" I sweet-talked her, asking if I had done something wrong or if there was something else I could do to make her job easier. The next day she contacted the local DO. A day later I had an previously scheduled infopass - they told me that me interview had been scheduled the day before.

So...

Don't just send in the forms. Phone the person up (after a reasonable amount of time). Make your case over the phone that your file is the most deserving of all the files that they have on their desk. In general, their response is "I did some research, here is your status, and there's nothing I can do". However, if they want to, they can flex their muscles.

Yes sure, you need to do the follow up in any office. I contacted the senator's office last thursday. I called today, it went to message. I will call her again tomorrow. I hope they will help me to spped up the process. I wrote a letter saying the how it is affecting my career and personal life.

Ususally, How long they take? I am calling every two days once and no reply from both congressman and senator office. Any thing else we can do? I already wrote to ombudsman and Director. How long ombudsman takes to respond?

Usually it takes 2 weeks after you submit your request. I got a reply from congressman after 2 weeks. They checked the status and wrote me back. I wrote to them again, I know the status can you do something to speed up the process??

I also wrote to senator 12 days back, waiting for the reply from them. I have an infopass appointment tomorrow.

My husband (citizen) and I filed I-130 and I-485 april 15 2005, we have not even received an interview, I have done everything possible to check my case status, and everybody just tell me that my case is pending and I have to wait. I AM CONSIDERING TO PROCEED WITH THE "WIRT OF MANDAMUS" AGAINST USCIS, but I have so many questions? can somebody help?

These people are human and have a whole pile of cases to look at. Think about it - if someone called you and whined to you every two days would you do something good for them. In spite of the fact that they have a mundane job, they get to pick and choose on which case they will expend their energy. Be *very* nice to them.

And, if it works out, send them some flowers after you get your natz cert, it will help the next person.
 
Did you get an NOA and Finger Printing notice? Did you do an info pass? If so did they say your background check is pending or something like that?
