Successful H1B stamping at Toronto

I wanted to share my experience of getting H1B stamped at American Consulate in Toronto since it is little different then most of the experiences posted here. I am citizen of India and went to Toronto to get F1 to OPT to H1B stamped. I have been in US for past 5.5 yrs.

My appointment was at 8.30 am on 23rd October 2003 at the consulate in Toronto. The procedure was very standard. You need to wait in the line outside the consulate and one by one after security the guard lets you in the building. Once I was in the building, I submitted my passport, I-797, DS-156, DS-157 and photograph to the counter. After this one by one the consular officer at different windows annouced the name with the country the passport is issued. My name was called within 15mins. The women at the counter asked me what documents I had. She didnt ask me for any specific documents. So one by one I gave her all the documents that are listed on the nvars.com website. She looked at my documents very carefully and told me to wait since her senior will call me for further interview. At this point I was at the peak of anxiety. After 10mins I was again called by the senior officer. He was very polite. He asked me lots of questions regarding my education and work. Finally he told me that everything looks good. All my documents are in order. But since my education and work is in the field listed in TAL they will have to get security clearance from DC. He told me that this is very standard procedure and I need not worry its just time, since it might take anywhere from 3 weeks to 3 months. I gave me a piece of paper with date of 14th November to call consulate about the status of clearance.

After talking to my lawyer and people at university (since I work for university) they all suggested that I should stay in Canada and not try to go to India or even back to USA (sometimes u can sneak in through border at Niagara Falls since many times they dont check passport properly!!!!). So i decided to hang in Canada untill my security clearance was cleared. I called on 14th November as I was asked to between 2-4pm. The lady told me that havent heard from DC and I should keep calling. If I want I can call daily too.

After 14th November, my frustration was at peak. I kept on calling everyday at 2pm and I had the same answer. Finally on 24th November when I called they told me that the security is cleared and I can come anyday from 8-11am with all my documents to get visa stamped.

I went back to consulate on 25th November at 8am. It was again the same procedure to wait in line, and one by one after security is cleared they guard lets everyone go in. Once I was in I submitted my passport, I-797 and the little paper that was given to me first time which is the authorization to come to consulate. I submitted the papers to the window to the women. Fortunately she remembered me from my conversations on phone everyday at 2pm since she was the one who used to answer. She was very nice to me and wished me good luck.

Well this time I had to wait for 2 hrs before my name was called, Since the give first preference to people who have appointment. I was called by a senior officer. He asked me why do I want to go to USA. I told him the answer. He told me what did I do in past few weeks. Did I go to India or back to USA or was in Canada. I told him I was in Canada and he told me I made right decision by staying in Canada otherwise things might get more complicated. Then he gave me a sticker and told me to come next day between 3-4pm to collect my passport and I-797. He didnt ask me to pay reciprocity fee. However my lawyer told me if the dont ask, I should tell them that I need to pay. Because if they find out later that I didnt pay, then there will be delays in getting passport back next day. So I told officer I need to pay reciprocity fee. He gave me a silp and told me to go to 3rd floor and pay USD50 and bring him back the reciept.

The next day 26th November i went to consulate at 2.15pm since I thought there will be long line in collecting passports. But they had already started giving passport. Within 5mins I got my passport and was relieved.

Since the next day was Thanksgiving day, I got a good deal on flight so I flew Air Canada back to USA. At toronto airport the immigration officer was very nice. He was friendly and didnt ask much. He just asked for my old passport. He took my old I-94 and stamped my new one. Within few hours I was back on US soil. And finally the long nightmare ended on the day of Thanksgiving.

Finally I would like to advise all the people that they are doing security even if you are Indian Citizen if your area of work lies in TAL. They do MANTIS clearance for TAL rather then CONDOR for most of the other cases. MANTIS data suggests that 90% people get approval within 30 day, in remaining 7% hear within 2-3 months and rest within 4months. Also I did meet an Indian couple at the consulate when I went again who were also waiting for visa after security. Their visa was denied even after the clearance was received. I didnt get chance to talk to them why it was denied or they needed more documents. So I guess lot of things depend on luck too. But in general the people at consulate were very nice and friendly. I guess its frustrating when something like this happens and you have to wait for security clearance. But I think the people at consulate are doing thier job and they do what the rules tell them to do.

I havent seen any experience by Indian citizen who has gone through security clearance. I hope this information helps for people who are planning to go to Toronto for visa. I will be happy to answer any other questions.

I'm planning to go to Ottawa for H1 transfer.

Please can you give us the details of Fee and method of payment.
On whom do we need to take the cashier Check.

If I take in US, will they accept ?. or can I pay by cash.

I went to Toronto and for Toronto you need to pay the $100 fee to Scotia Bank before you go to Consulate. I am not sure about Ottawa. I belive that you can pay by cashiers check.

Once you get visa u need to pay $50 reciprocity fee (u dont pay this if u are Canadian PR with Indian passport). I paid that fee by cash. They accept US and well as Canadian currency for this. I paid by equivalent Canadian currency.

H1B revalidation in Toronto, Canada

Hi,
I need your opinion for H1B revalidation in Toronto, Canada.

I am on H1B visa and already working for a new employer for 1 year based on an approved visa and pervous company's stamped visa which expired on 26 Th Dec 2003.

I am planning to get my H1B visa stamped from Toroto, Canada.
I also have a Canadian Immigration Visa stamped on my Passport and want to get Visa stamped in Toronto while I land in Canada for my Immigration. After landing in Canada I want to get by H1B visa stamped and return to USA within one week.

My question is, since I will have just enter Canada as Permanent Resident and would immediately want to get a H1B visa. Would that be a problem? Wouldnt The officer in American Embassy ask me that you just landed in Canada and you want to go back immediately? Could he reject me a H1B visa based on that?

Please let me know what you think?

Hey guys. This is really wonderful. I just called the DC and found out that my visa has been approved and finished printing too and the process completed yesterday and should be receiving ASAP.

SL Date - 26th Sept.
DC Date - ???
Process completed - Jan 7th.

Paperwork for h1b stamping in Toronto

Hi - I'd like to know what paperwork / procedure is required for h1b visa stamping at the US counsalte in Toronto, or from where can we obtain this information ? I am planning to go for stamping of my h1b (3rd employer) visa. I already have two h1b visas stamped in my passport. I had come to the US on f1 for a MS in 1999.

port of exit question

I have an appointment at the Toronto Consulate for jan 20th. The question i have is regarding port of exit and things you need to do before you leave the US according to the new regulations posted on the state Department wesbite.

The new US-VISIT programme requires all non-US travellers to get registered at the port of exit before leaving. Has anyone of you experienced this and do you know where i need to go on a port of exit to get this paper work done.

Just wanted to share my experience with all of you. This board has been a great resource and help for me and many others in my situtaion.

I just came back to the US from Toronto with an H1B stamp in my passport. I was there for a total of two days, although i had planned to remain there if they decided to do a back ground check on me (which could take upto 4 weeks). Luckily, i got the visa the second day. I applied on a Tuesday and got the passport back the following day between 3 and 4.

The whole process was pretty simple. Walked in the consulate at around 10:00 am, my appointment was at 11:00 am but they let me in earlier. I stood in a line to first enter the consulate and than in another line to submit my papers. Submitted DS-156 and DS-157 (with one photo), passport, visa fee (USD 100). Than i was asked to have a seat and wait. There were quite a few people there and all the seats were taken so just stood there for a while till i could find a seat to sit down. You could tell people were really anxious and nervous to be there as i was too. Anyway, finally around 11:10 am my name was called. The lady asked me "Give me all your documents". I gave her my original I797 approval and all the documents that were submitted by my company to the INS for my H1B. Than she sorted those out and only took what she needed. She returned the rest to me. She than asked:

Q: "Give me your original US degree"
A: No answer. Gave her my original US degree.

Q: "So you have never been home since coming to the US in 1998?"
A: "Thats right".

Q:"When did you became a permanent resident of Canada?"
A: Gave her my landing date.

She than glanced at all the documents one by one and asked me to have a seat and an officer will call me.

This wait was a lot longer. I got called at around noon. The gentleman there was very polite and friendly. I greeted him a good afternoon as i walked to the window. He polietly acknowledged.

Q: "Since how long have you been working for company XYZ.?"
A: "Since ...... 2001."

That was the only question he asked me. He than glanced at all my documents one by one and circled a few things. He than started to write me a ticket for the passport to be picked up the day after between 3 and 4.

And that was it. The whole interview process was very smooth and without glitches. One thing i should mention "please donot argue with the officers nor with the security guards". There was lady (from China i think) who was arguing with the officer about her paystubs. She didn't have any. All she had was a letter from someone showing her pay for a year ago and even that was not current. So her visa got declined but she kept arguing really really loud. The officer than had to call security, who escorted her out of the building. As she was leaving she was screaming " to hell with you... all.... blah blah blah". That was kinda scary episode.

I kept a close watch on everyone and seemed like majority of the people there got the visas. So i think as long as you case is straight forward and you have all the necessary documents. You will be fine.

I am now back in US and very much relieved that i got the visa!!! The Guys at Toronto consulate are awesome!!!! and i really appreciate how they handle all the rush and people from around the world with many different languages and accents.

Where you live while waiting for security clearance

Hello all,

I plan to convert my F1 to H1B in the next few months (I got expired F1 since 1999), so I could expect they may do background check on me.
I just wonder
1) where you can find the cheap place to live for months while waiting for this.
2) where you can find internet connection or so to work remotely if needed during the waiting.

US visitor visa from canadian US consulate

My friend has been in US on F1 and then H1 visa.snce her was Up she moved to canada since she got her PR here in canada.When she applied for US visitor visa they said they need to do further processing since her field of work is research in science and that Basic science.How long will the check is the VO said 3 to 4 business weeks.Does the area of basic science research comes under TAL.She is a PR in canada.

Being Canadian PR is of no significance for U.S. visa. TAL verification is predictable usually takes 3 to 4 weeks. Please check out (search if necessary) this forum.
