Successful H1 revalidation stamping on Aug 7th, Nogales

Hi Folks,

It was a great experience overall, getting visa stamped in Nogales, Mexico.
More details to follow later this evening. I think it was 100% success rate on Aug 7th for H1, J1, F1 and dependent visa stamping, as far as i know.

Please take your latest RESUME (n/a for dependents) along with all other necessary documentation. Some of the visa officers specifically asked for it.

I am on my 10th year of H1 and my I140 is approved. I am bout to get my 3 years extension based on approved I140. Do you see any issue getting revalidation fro Mexico based on your experience?

I too went on aug 7th to Nogales for stamping.

My state before entering Mexico:
1) Had an expired H1B visa stamp
2) Had a new I797 approved for work till dec 2008.
3) same company before and for the new I797.
4) did not have a banamex receipt for US visa application fees.
5) had an appointment for 8:30 am on aug 7th.
6) had photos but were incompatible with the standards of us visa.
7) did not have a permit to enter mexico, or a visa to mexico.
8) company had applied a tradition labor pending at dallas bec
9) company successfully applied a parallel perm.
10) company applied for 140 based on parallel perm
11) didnt have any valid visa to reenter usa if the visa application got denied.

My main issues in Nogales:
1) I didnt have pictures.
2) I didnt have banamex receipt
3) I didnt have permit/visa to get into mexico.

travel
Fly: SLC->PHX
Car rental: AVIS
Drive: PHX->Nogales (180 miles)
Hotel: Bestwestern

At bestwestern:
Met vikar, shravan, harsh, catherine and few others. Most of the folks, except catherine were for H1B->H1B visa stamps, some with MS and some without. Catherine was for H4->F1. Most of us did not have entry-permit/visa to enter mexico, so there was company in misery:) We had an uneventfull sunday and retired for the night early.

Monday
Banamex I gave shravan money and copies of my passport and appointment letter. Shravan headed to banamex near the us consulate in nogales, mexico to get the receipts for both himself and me. bank opens at 9:00 am.
Photos I meanwhile got my photos at the local walgreens in Nogales, USA.

Nogales USA to Nogales Mexico
I took the photos at walgreens, checked out of bestwestern, drove my car to a parking lot in USA right next to the mexican entry point, parked it ($4) and walked across into mexico. no checking at mexcian entry...but once you cross the turnstile into mexico you will need a valid visa to reenter into US.

In mexico I said "banco banamex" to a cab driver, he charged $7 for the 3 mile 10-15 minute trip. Didnt see shravan at banc so said "consulado americano" to another cab driver, he charged me $3 as I shared it with 3 others for the 2 minute trip.

shravan had the banamex receipt ready for me at the consulate. So finally I had receipt and photos at the right time, thanks to shravan.

US Consulate experience
Your appointment time is irrelevant. You can go there anytime before 11:00 AM. You will stand in a line outside the consulate. A lady checks your 156, 157, 158 forms and allows you to go inside. Inside, a lasy checks your 1797 , passport and receipt and then gives you a token number. There is a place to sit and wait untill your token number is called for photographing and finger printing. After that there is another place to sit and wait for your token number to be called again for actual visa interviewing.

Visa interview
interview was very short, comfortable and successfull for all the people I got in touch with. They didnt ask me anything. For some they asked resume at most. But in general it seemed a wise approach to have all the docs ready. The consulors then told us to go and pay the $50 reciprocity fees. Which all of us did.

Wait for VISA
After that we all had to wait untill 3:00 pm to collect our visas. which we all did at 3:00 pm. In the interim some of us went to a good local mexican hotel, "tracdero" i think. Good food. price same as in usa.

After VISA
After that some of us went back into USA while some just hung around and did some shopping and general roaming around. The place seemed very safe and people are very friendly.

Points to note:
-Can go to consulate anytime before 11:00 AM.
-Dont need permit to go into mexico.
-dont need visa to go into mexico.
-not having these and a visa to get back into US and the visa application getting denied could pose some complications though. I heard in such cases one can approach the mexican authorities on the border and seek help.
-can get banamex receipt on the day of visa at the banamex near consulate.
-no need to use the local consultants help.
-can get the photos done on the us side of nogales.
-keep all the documents ready.
-the guy who didnt have the resume finally wrote a resume on plain paper i think.

Nogales, mexico is friendly...most people dont know english...some know a splattering of it...some are good at it. But one should be able to get around if one wants to. In infact I recommend that one set a couple of days free to roam around the near by towns and nogales itself after the visa process. You will savour the experience. I liked the few hourse I, catheirne and harsh spent in "down-town" nogales. we bought some stuff and had some drinks at a local bar. if you go shopping make sure you bargain hard..there were certain items a shop keeper dropped the price from $60 to $5 after bargaining...though i think the shopkeeper still had a good laugh at my expense. I loved the place...but then it doesnt take much to please me so be your own judge.

I can see you have received your labor and I140 Pending/Approved. Did you get the extension based on pending green card? Was it (extension) for 3 years based on approved I140.

My H1 history is as below:
Jan 2002-Jan 2003: company A
Jul 2003-May 2006: company B
May 2006- Dec 2008: company B


So, my current H1 extension includes both the within 6 year extension and the 7th year extension.

As detailed in response to your previous question...the H1 is for both within 6year and green card 7th year extension based on pending traditional labor but not based on approved perm dependent pending 140.

Other than myself i didnt meet any case based on pending green card...i might be wrong...if there is one then i hope he/she will respond to your question.

I personally do not see any issues. the job of h1 approval based on pending green card has already been done for you. The consular is not gonna distinguish H1 approval reasons. Thsi is just my 2 cents but there is nothing to worry.

Hi Akshay,

It was a good experience. I thought of writing a complete detail list but got stuck in regular office work. Probably this weekend I will sit together and make the list. However guys. who are all are thinking of going take following list of documents in order :
0. Passport (Ofcourse, :) thats why it is number 0 :D)
1. Forms 156 (Fill Electronically on website it helps as the form received by Consulate directly).
2. You need to fill Forms 157 and 158. (They are checking before you enter consulate)
3. BanaMex Receipts (You can get on the day of apt just go at 8:45AM you should be out by 9:10AM - takes only 2 mins at counter to get it) You can walk to consulate (It is just 5 mins walk you can't miss the road, I will try to draw a rough sketch and try to post it)
4. I797
5. Passport Photo
----(You need to submit this to consulate before appearing interview).
Other forms include
1. Resume (This is must. Donot forget have one latest one)
2. I129 (Thought they ask only the latest one, nothing wrong in keeping the previous 129s, just in case)
3. Employee Letter and Client Letter(if you are consultant). (They just have to state that you are working from x years. You are earning y salary addressing consulate)
4. W2 and Tax Return Forms
5. Last 6 months of Bank Statements
6. Any supporting documentation (In my case I took copies of My labor approval etc)

On the day we went there are total 100 people(including local) came and everybody got visa. Some people took help of agent and payed some good amount of money but, I think it won't be necessary, ofcourse it reduces your tension. However they can't help in Visa stamping. You have several Hotels near the border and near consulate (some 3-4 people stayed in hotels near by consulate).

Will try to put all questions I had before my interview. how I resolved and my exp I will post this weekend.

Hi Folks,

Day before the interview
Flew from San Jose to Phoenix on Saturday night (Aug 5th) through Southwest Airlines.
A friend picked me up at the airport whom i got aquainted through this forum.
Sunday morning, made another trip to the airport to pick rental car (Dollar rental) and another friend who came from SFO.
We left around 10am and decided to go Udipi Cafe in Tempe (1/2 hr drive from PHX) near Arizona State Univ.
It opened at 11am and the lunch buffet was awesome. 10 times better than the one in Fremont, CA.
After lunch, we drove to Nogales, CA and reached at around 2:30pm.
It was a little confusion at the last exit, because we didn't know whether to take Grand Ave exit or continue on I-19 (towards Mexico) given by Google.
We took Grand Ave exit and drove a few miles to Best Western Hotel which was on the right.
After checking into the hotel, took a small nap and in the evening, took a walk towards the border with other buddies.
We took a look at the turnstile and the surround parking lots.
Then, had dinner at Taco Bell on Mariposa Ave and retired for the night.

Day of Interview
Woke up around 6am and got ready by 6:30am.
The hotel provides complimentary breakfast.
Checked out at 7am, since we had a 1 day hotel reservation and decided to drive back to phx the same night.
Drove to the nearest border parking lot ($4).
Walked towards the border and once you are through the turnstile, you are in Mexico.
There are lot of cabs waiting nearby the border.
I carpooled (with 2 others) and went straight to the banamex bank. Paid total $8.
A few others who got their banamex receipts through Mark or Victor went straight to the consulado. I heard they were letting them in around 8am onwards.
The bank officials come around 8:30am and opened the bank at 9am sharp.
Within 10 minutes we were on our way to the consulate. It took around 8-10 min walk.
Items not allowed inside the consulate can be stored at a nearby place for $3. Advice-group the items, otherwise you pay $3 per item. A few of our friends stored cell phones separately and had to pay $3 each.

Interview
At the consulate, there were a few folks ahead of us.
BTW, my appointment was at 8:30am and i reached around 9:15am.
A lady out the consulate checks for the name in the appt list, DS156, 157, and 158 forms.
At around 10:00am I went inside and another lady checked for passport, banamex receipt, I-797. She glued my photo to the DS-156 form.
Received a number and had to wait for around 1 hr for BIOMETRICS.
After biometrics, you go to another section for the actual interview.
It took a while for my turn. At around 12:45pm, my number was called, and the VO (Visa Officer) greeted me.
She asked for my Passport, I-797, DS-156, DS-157 and DS-158 forms.
She looked at them and asked for my RESUME.
She asked where i was working. I replied with my company name.
And she said, my visa is approved.

Post Interview
Went to another room to pay the reciprocity fees. Have to wait for 10 mins or so as that officer was not at his desk. I paid $50 by cash. They also accept credit cards.
They asked us to come back at 2pm to enter our name and passport number in an excel spreadsheet on one of the 4 computers inside the consulate.
Since it was close to 2pm, after paying our fees, we stayed inside the consulate for another 15 minutes and went and entered our information.
We left the consulate, had lunch at KFC and came back around 3pm to collect the passports.
It was a long wait again. Got my passport around 3:30pm.

Return to Border
Walked down the street and took a cab back to the border with 2 other friends. Paid $7 in total. The drive took around 15 mins.
There were 2 lines near the border entry and stayed on the line to the left.
All non-immigrants will be requested to step aside. Had to wait for another 30 mins.
A border patrol officer took our passports and entered our information.
Our passport was returned and we were then escorted upstairs (around 4:15pm) to be issued the actual I-94 for multiple entry. Paid $6 fee. The wait was 1 hr.
By 5:15 pm we were free to walk back out the door.

Back to Phoenix
We decided to drive back to Phoenix and started around 5:45pm.
There was a border checkpost and they checked our passports and we said we went for visa stamping.
They let us go after checking and we were back in PHX around 8:45pm.

Thus concludes a thrilling experience.

Yes, a few of them. One guy came for 8-10th year H1-B revalidation and got it approved.

[ASK] When i filed (and received) my 7th year extension, my I-140 was not filed. So i got an extension for 1 year only. Now since i have my I-140 approved, the next time i file for H1B extension, i will get it for 3 years, assuming 3 year rule doesn't change then.
Also my PD is not current and hence waiting to file for I-485.

All the best at your interview. Regarding H4 I am not sure abt what docs. But as you go together One marriage certificate should be enough. I don't think any separate documetns needed.

is anybody applying for 7th or higher year exten .. do you claim in applied for immigration on Form - DS 156 , section 36?
just filling the labor does it mean we should state as we applied for immigration?

I heard from my friend who went for 7th year revalidation, put "NO".
He has filed for LC (labor cert) and is pending when he went for visa stamping.
I was also told by him that you put "YES" only when labor is approved and/or you have filed for I-140.

You only say "YES" if your labor is cleared and applied for I-140.
