successful cp at Mumbai on November 28th

Many guys have posted their experiences with cp on this portal before and I don\'t think I can add much to the pool. But it is always good for someone who is going to India to know that the process is flowing as smoothly as ever. We, me and my wife, had our cp done on November 28th with no hassles at all. We did our medicals at Lilavati. Very smooth process. I got my photos done at My Own Photo Studio (100m away from the consulate across the street). Both, medicals and photos, were easily done on the same day. Photos were readily accepted at the consulate.

Consular processing itself was smooth too. ALL employment based applications on the day were approved. Salient features of my case are as below.

1. My company had gone through a take over during my gc process. My immigrants petition (I-140) was filed under "successor in interest". No problem at all.

2. My first H1-B had expired in October and I had filed for a new one before the first one expired. But I had to leave for cp before I got the new H1-B approved. When the H1-B related documents were asked, I submitted old H1-B and the receipt (the one with LIN# on it) of the new application. Consular officer was satisfied with what she saw.

3. My company had moved within a few miles after the take over. I did not have to move myself because the new office was still within 20 minutes from my home. No problem at all.

Similar H1 issue

Few questions. Were you asked about the H1 issue during doc collection or when the American officer interviewed you? How did the H1 issue come up in the conversation? - they don\'t usually ask for it. How long did the interview last? What other questions were asked if any?

A few questions:
1. What questions did the consular officer ask you and your wife?
2. There\'s a rumor floating around that Police Clearance Certificate is now required for all Jan CPers who have lived in India/US only. Is this true? Practically, I don\'t think it\'s true but a lot of them have been frantically calling the Consulates (Mumbai/Delhi/Chennai)and getting mixed replies. Did you happen to see any such notice posted near the information window at the Consulate?

Hi, the consular officer looked at my visa stamp and realized that my visa stamp had expired last month with my previous H1-B approval (I-129). I immediately forwarded the old I-129 and the receipt of the new application and explained that the new H1-B application was filed prior to expiration of the first one but I had not had the approval while cp interview was scheduled. She looked at dates on old H1-B, dates of filing the new H1-B on the receipt and asked me for copy of the receipt. The only thing she asked was the date when I reached India. I guess she made sure that I was consistent. She was convinced that the documents were consistent. There were no other questions asked. The total interview (part1 + part2) lasted less than 10 minutes.

My wife wasn\'t asked any questions at all. I was asked name of my employer, title of my job, and the area I specilize in.

The consular officer did ask me if I stayed in any country except India and U.S. for more than six months in last few years. I said no, so I was never asked for police certificates. As much as I know, none of the other candidates on that day were bothered about this either. I don\'t remember having seen any information posted there regarding this. Do refer to packet 4 received recently. Also, do look up on the web-site of the consulate.

I got my I-140 approved on Nov 28 and going for CP in chenai.I\'ve a few questions .

1.I have a H1 valid till 2003 (joined this co in 2000)but the visa on my passport is from my old compnay and expired on Sept 14,2001.
Is it safer to stamp the pp with my current co before CP interview

2.Along the same lines how long does it take to receive Pkt 3 after
  140 approval.

3.My lawyer once mentioned that I might have probs in CP since
   I have BE+5 yrs exp and appiled for EB3 .Any truth in this stmt?

Ans: You mean you have an approved I-129 (H1-B), but the (multiple-entry) visa stamp in passport expired on 9/14/01. It\'s not necessary to get a new multiple-entry visa stamped if you don\'t intend visiting India before your CP. Since you have a valid I-129 you should be fine for CP.

2.Along the same lines how long does it take to receive Pkt 3 after
  140 approval.

Ans: It takes about a month or so for the P3 to arrive from the NVC. But there are many who fill out their P3 as soon as they know that their case number has been created by the NVC and mail it to the Consulate, just to save some time. But I had waited for the P3 to come from the NVC.

Ans: I don\'t see any problem with BE+5 yrs exp applying for EB3. Anyway, at CP they are not concerned with your qualification & experience unless it\'s a fraud case. That\'s all done at the LC stage. Your lawyer might be misinformed.
