Successful change from H1B to F1, but still need advice from guru

Hi everyone!

I would like to share with you with my experience. I got laid-off in February, but got admitted to an University before the laid-off date. Immediately, I filed a request for change of status from H1B to F1 and it was granted after 60 days when INS received my request.

Now, I started my summer school. I have a few questions for the guru here and hope someone would help me. Thanks in advance:

a. I don't have a visa because I just change of status. Thus, my visa is still H1B. Now, I want to travel outside the United State for summer vacation, can I get my student visa in Vancouver, BC ? It is OK to do that ? (PS: I am a Malaysian, where Malaysia just recently declared as a Muslim country)

b. What if my student visa application is rejected in Vancouver BC, can I come back to the State ? My H1 visa still "valid" until 12/9/02 and my ex-employer haven;t report to INS. can I use H1 back to the state or it is too risky to do that ?

b. What information is needed for me to get my student visa, either in Vancouver BC or in Kuala Lumpur, Malaysia ?

P/S: I heard that the ambassy office in Kuala Lumpur process F1B visa very slow... more than a month, thus, I am now thinking getting my visa in Vancouver BC instead since it only take one day.

I changed from H4 to F1 in 1998 and went to Vancouver Canada for multiple entry visa and got rejected. The reason - they cannot verify my ties with my home country and I have to apply for F1 in my home country. At that time I was able to come back with my F1 approval as I do not need to give the I-94 at POE while going out of US. But I think some rules have changed since then.

congrats on winning another visa battle! I am planning to apply for COS and had a few quick questions for you.

a) did you send a letter from your employer? if you did, did it have the last date of employment in it?
b) did you send in the originial I94 or copy of I94?
c) Is there a 30 day rule for COS? i.e. you can not file COS before 30 days of start of classes?
