You CAN file a DV based i-485 EARLY.
But it IS NOT 90 days. It is AFTER whatever the date your number is mentioned in the advanced notification area in the VB.
Normally the VB is issued around 8-12th of a month, so it usually only about 50 days early.
Make sure you note in BIG letters that your i-485 is DV based and make a p/o of the VB DV cut off part and include that too.
Pl go to 'DV AoS Only' forums in 2012,11 and 10 and read through how people handled this issue during the last few months of the FY.
