Submit I-602 For Fraud !!!!! ? PLS HELP US WITH WHAT YOU KNOW.

"You have been found to be inadmissible, or ineligible for adjustment of status under Section 212(a)(6)(C)(i). Misrepresentation "Any alien who, by fraud or willfully misrepresenting a material fact, seeks to procure (or has to sought to procure or has procured) a visa, other documentation, or admission into the United states or other benefit provided under this act is inadmissible". Therefore, you must complete the attached Form I-602, Application By Refugee For Waiver of Grounds of Excludability."

:confused: So Please what are my options for getting my GC (Asyl: ND FEB2002) after spending more than two thirds of my adult life in this wonderful country and how can I make sure that this waiver succeeds? :o Thanks to everyone who shares their experiences and contributions. I gained alot from this forum.

I think this form has been discussed in this forum, look through the recent posts. Also, talk to your lawyer.

I had the exact same I-602. See Want's excellent I-602 template, and read through my post: http://immigrationportal.com/showthread.php?t=203302

Somewhere in the stickies, there is a post that states that CIS has issued a memo that basically states that they will not ask for RFE if the application will otherwise be denied. I did not see that when I responded, but all the same believed that they would have denied me directly if they wanted to--so being asked for the I-602 is a good thing.

So I'd suggest not to worry but do just the way the form asks. I can send you my cover letter if you want, or you can just follow the template in the sticky.

can you share what did you do to get this I 602?? did you claim citizenship???....Guacho.

Do not panic. Calm down. The history goes like this, in 1996, a law was created by Clinton which said if you had illegal entry into the United States, you were inelgible for adjustment of status. In 2001, they created a law called 245(i) where if you paid 1000 bucks, they would've waived this law since you paid a fine. That law expired.

Now fastforward to your adjustment of status. They have to follow the laws of the United States. However ONLY Refugees/asylees are given a free pass on Illegal entry or illegal stay beyond your visa.

The important part is this, you need to explain in your I-602 waiver that you never intended to misreresent the United States government.

I got the same waiver request and I am approved and so are others. You need to follow this template and insert your history in this document. 3 other members of this forum have used this forum with my help and have been approved. Create a MS word document and copy and paste the above text and then start to follow the items in it. Make sure you follow the same story as your asylum case.
