I called the CIS on 17 Sep 04 to find out why they are not taking up our (me & my wife) cases for processing even tough they had all results (FP & FBI) while they are approving the Dec 02 cases (many of my colleagues with RD Dec 02 got approved). Their answer is crap like “every case is different”.

As a result of my enquiry yesterday I received a letter from NSC with the following text.

The address on your I-140 application was changed. In order to process this CHANGE OF ADDRESS, fill out and mail the enclosed AR-11 to the address indicated in the form- I never mentioned about ADDRESS CHANGE and my I-140 was approved 2 years back.

Your I-485 application was received 8/6/02, the NSC is currently Processing applications of this with receipt dates of 2/1/02- Our RD 8/28/02 and ND 8/29/02.

I don’t know what to do, I have contacted two senators and one congressman, their answer is that they can’t do anything as the processing date is 2/1/02. Congressman contact person even told me that approving Dec 02 cases is just a fluke.

I think its your stupidity to bother them with calls... senators... congressman..

What are you trying to do ??? Screw up your case beyond repair when nothing really has gone bad in your case ...

Have certain genuinness in your approach. And if you do not agree with bcis time taken or anything ... go sue them.

kcdesi,
fillout ar-11 as they said even though you did not change address. there is nothing we can do man. Just pray and be patient. you time will come soon.
once in a while call customer service. when your time comes , the rep might do something helpful.

I've exactly the same case: I called for an inquiry and they took my info etc, as if they were accepting it. I got excited. And then after 33 days, we got the results: ..."ave received your address change request...". I've said it before - incompetency. The people that take the calls, are lacking qualification and they send the inquiry, then CIS "rejects" it, by responding with a standard, stupid reply.

I agree! This is only messing up things! I don't understand why people with RD 2003 are contacting senators. What do they expect???

I speculate that USCIS is asking you to fill out the address change form (obviously after you called them) and then they will update your record. Now your case has been touched. And it doesn't fall under backlog.

FYI, just by 'touching' a case does not come out of backlog. If a case has not been adjudicated for over 6 months it is considered backlogged and only if it is transfered or adjudicated is it considered 'not backlogged'.

I contacted Sen Durbins office last month. He sent a standard letter saying that they were processing 02/02 and I will have to wait until my dates get current. When I called the guy back, he was able to give details including FP2 and name check cleared dates and he said the files are waiting to be assigned to an officer. Only thing I can do is pray.

NSC seems to be very random these days and they seem to be working to be least efficient so they may get a slap and maybe additional funding. Who knows.

I really believe these kind of things might also be adding to our woes.. Why would anyone file an AR11 and think that will expedite the process. This must be causing unnecessary staff assignments and hurting the true processing of cases...

Guys get out of Desi thinking and get real.

I think AR11 will be part of Homeland security and nothing to do with Immigration processing.

and secondly , that AR11 they are talking about is.. what the heck.. read the first post.
But I agree that this unnecessary queries are definetely making things slow.

you are 100% right

guys, the process is slow and it meant to be and stay slow, see...!!! they are testing how patient are you...so show patiency and tell the NSC that we will wait hundreds of years for the I-485 to get approved if neccessery :D .
