Study on H4 out of state collage?

My son is here with H4 since 2001 November. Can he apply any collage in the US or only in the state where he lives?

I have H1B and green card is under process.

Yes.

Check his age , if it is nearing 21 better change H4 to F1.


To make him independent to get scholarship, even get work in the university, F1 is best choice. But should not go out of US to get F1 visa stamped, because I 140 is in process he may not able to get his F1 visa.

H4 residente?

Hi
I am on H4 visa and I would like to know if on this visa I am considered resident in U.S., specifically Illinois, for college tuition purposes.

If the person whom you are dependent i.e the primary H-1B holder has been working in that particular state for more then 1 year and has been paying state taxes, he is considered a resident and hence you will be able to avail the facility of getting your out-of-state tution waive. Most of the U.S. universities follow this policy but some don't
 
Once you filed your I 140 or I 130 you are classified as pending immigrant status. But F1 is non immigrant visa with only intention of non-immigration.

So if you apply F1 outside US and you are pending immigrant you will not be issued a F1 visa.

If you paid atlest one year of IL state tax, you will be considered as IL residents for IL State Universities tuition fees. (Not private university). However the rules change from state to state . Check with your univeristy.
