Hi Rajiv please help..

I came to US on H4 and then converted to H1 but was never on project(for more than 1.5 years). Now I got EAD thru my spouse.
Is there any problem if I stay on H1 without being on payroll.

Can I do PhD, paying instate fees and apply for TA/RA in the university.

You should start using EAD .
Yes 3 months into H1 you should have switched back to H4. But with the EAD you are okay to take up fresh employment. Dont forget to get AP for travel. Keep renewing EAD and AP diligently
