Hi ,
I had applied for Employement based Green card about 5 months back with substitute labor. Both my 140 and 485 were filed together. About 15 days back I got the EAD approval. My 140 is still pending approval. My H1B expires in May 2006. I am planning to start two year full day time MBA this August. I will be leaving my current employment. I had following questions

1) Can I leave job and start full time study on EAD and continue my Green card processing. (Since GC is for future empl)

Your response will be really appreciated.

Regards

You don't need an EAD to study. However, when USCIS asks for your offer of employment, what do you intend to do?

Thanks a lot for your response.
I suppose the offer of employment is needed after the GC processing is complete. If my employer is willing to employ me after my education , will that suffice. Also my wife is expecting her EAD soon and can start job (if that effects somehow)

You will need an offer of employment when your I-485 is approved, not when your education is complete.

No, it doesn't. You're not getting a Green Card for your wife to work - it's so that you can work. If USCIS queries you and you do not have an offer of employment, your I-485 will be denied.

With the premise that my employer maintains the status and is willing to offer me employment at the end of Green card processing.

Once the 1485 is approved and I am still studying: I can join the job and take a leave of absense for remaining duration of my college.

If the 485 gets approved after my education then there shouldnt be an issue.

Please suggest if this is possibility

What do you mean by this
" .... my employer maintains the status .... "

There is no "status" for your employer to maintain.

Sorry, by "maintaining the status" I meant that the employer doesnot withdraw the 140 and 485 petition.
