I currently have a Student Visa but am switching to a H1B. Can the H1B Documentation (FedEx) be sent to me in the US or does it have to go to my home country of South Korea? If it can be sent to me (or my lawyer) here, do I just need to go back home to the US Embasssy in Seoul to have the papers stamped? Is there a time period I have to wait from when I leave the country on one visa to enter on another visa?

Thanks in advance guys.

Door service...

I presume that your lawyer filed for change of status too ... Your lawyer can receive the H1B approval and can send it you. You can visit mexico or canada and get the stamp in your passport here. Of course you can also go and wait in your home country and get the stamp there. IN which case ask your lawyer to include a request to send the approval notification to your country\'s US embassy , while applying for the change of status/h1.

No visa is needed

If you are in USA, you donot have to leave for a visa.

Once INS approves your I-129 (w/ 539, change of status) petition, you are granted H1-B STATUS--You can stay and work for the stated time, usually 3 years.

However, if you want permission of entering US, you must apply visa at a US consular (it belongs to department of state). When you arrive US, you submit your H1-B visa and INS (usually at the airport) will grant you H1-B status (a stamp on I-94).
