it is not from the time u get ur biometrics and FP its from the time u submit ur application... name check is done by running the information u fill in the biographic information (4 pages) that u submitted with ur I-485....

I assume after 3 months of submitting ur application if u called the SC or took an infopass and they told u ur still pending namecheck.......... then u r stuck my friend....

both stories are true. I mentioned both of them in several posts. I also mentioned that I can't be sure which one actually helped me (or may be neither one, or may be both helped ). I asked for help everyone I could: priest, president, congressman, 2 CA senators, ombudsman, mr. Williams (CSC-XII.485), lawyers, etc.

It is my lucky turn, finally!

Just got email from my congressman's office, confirming that my NC was cleared on OCT-05. I did send the FOIPA and got a reply (no record), both in DEC-05, so obviously that did not help for my case at all. So, I feel that they are indeed working on the very old cases. Wish you guys/gals good luck too.

Thanks hugely for everyone here and all the encouragement I got that keep me hopeful in a long dark tunnel. I am now waiting for my priority date to be current, and hope it won't be too long!

How do I know when NC process started

My details are: I-485 ND in Sept'04 and FP in Apr' 05.

In June '05, I found out that my case was stuck in Name Check when I called VSC to enquire about my case status. However, they would not let me know when the NC process on my case started.

How do I estimate/know when the NC process began on my case.

NC starts almost a week after ur application was recieved.... they send ur biographic page ( the one u filled as part of ur application) to the FBI to check on ur background.....

Recently I have got a call from USAttorney who was defending USCIS in my lawsuit and she told me that when she got my petition through the court, she asked VSC to expedite my namecheck and it cleared about three weeks ago. After that it was up to VSC to finish up the remaining adjudication steps. As she promised, I have got my approval right by the Christmas.

how to file mandamus

Hi, Gegemon, congratulations! that was a great Christmas!
My I485 RD is 09/2003, name check pending for more than 2 years now. I am also thinking about the lawsuit. Would you please send me some info about how to file mandamus? thanks a million!

Finally my name check got cleared and I485 got approved! It happened 62 days after filing Mandamus lawsuit in my local district court.

Recently I have got a call from USAttorney who was defending USCIS in my lawsuit and she told me that when she got my petition through the court, she asked VSC to expedite my namecheck and it cleared about three weeks ago. After that it was up to VSC to finish up the remaining adjudication steps. As she promised, I have got my approval right by the Christmas.

Here are my details:
EB1-OR
I140/I485 RD: 03.2003
I140 AD: 12.2004
Mandamus Lawsuit filed: 10.20.2005 Pro Se (w/o a lawyer)
Name check cleared: 11.28.2005

congratulations! I would like to see if I can file a suit. Can you please post how details. My employer and Lawyer hate lawsuit and I am no my own. Any help appreciated
 
What is security check?

I receive a response from Tsc that my I-485 case is pending due to security check. Is security check the same as name check?
 
I thought that security check is performed by CIS and name check is the one done by FBI.... my friend was stuck in CIS security check for his H-1B for 5 months and they just cleared him....
 
Security Check cleared

I called VSC customer service today and was told that Security Check has been completed for case :) :)

They would not tell me when it was completed. I have been calling VSC every two months for the past year or so.

Now, I need to wait for my PD date to become current.
