I have an approved EB2-RIR (master's degree+6 months) I-140 from current employer. What is bothering me is the stated salary level on labor cert when it was filed back in may 2004 was $39k. That carries over on i-140. Would this be a problem when i file i-485? Will they say that the i-485 cannotbe approved because salary level is too low for EB2? Or is it the case that once the I-140 is approved, it says that the applicant is eligible for the EB2 classification and salary level etc are not checked during i-485 stage.
Gurus/Friends, please help.
PS:current compensation is $50k in the same position/job description. Raises were clearly not anticipated.
