Strange situation - please help

Hello:

I accessed USCIS web page and found that my I-485 has been approved (got emails too). However, my I-140 did not show any change (never got any emails).

I called USCIS and asked for their comments on this situation. They said that my I-140 was approved couple of months back and asked me to check back with my employer. They also said that it is impossible for the I-485 to get approved before I-140. My employer has not received any I-140 approval.

The USCIS person asked me to file a form to get duplicate I-140. It sounded like A2 form but I am not sure.

Has my case been approved from the above description? If you know the form I need to file to get duplicate I-140 could you indly share it with me.

Your comments/suggestion will be very useful.

Second.

Since 2002 concurrent process was introduced, ppl are getting approval together both of petitions 140+485.

Here what u need to understand, as many ppl shared their experience that they see online status check and they never got 485 approval notice too but they were approved months ago. and when they called customer care center they were told that ur case has been approve a couple of months ago and they were advised to get I-551 stamp done from local INS.

It seems u are in same situation ur 140 was approved but never got letter or online msg updated.

Wait for 485 approval mail notice and go to local INS office for stamping without any fear.

Will the I-551 be mailed to me by the USCIS?

The lady I talked to told me something like your cards will be mailed to you in 45-60 days. I talked to one of my friends and he said that does not make sense and said something similar to what you have written .i.e stamping at the local office.

If I were to go to the office and I do not have the I-140, is that ok? As they should have my case updates on their system (or) Will they refuse to stamp my Passport?

Take a copy of your 485 approval notice, 2 pp size pics, all EAD's, AP's, I-94's, and your Passport valid for atleast 6 more months...and of course your smiling face ... to get your PP stamped from the local INS office(after you make an infopass appntmnt online)...the stamp is good for an year....you might get your plastic card in a month or an year (depends on your service center etc) ... its always good to have your Passpot stamped for the interim...even if you were to get your plastic card in 30-45 days (but then, it could also be 9-12 months such as from NSC). No ones gonna ask you for I-140 approval notice (its given) ... with 485 approval, its not relevant. Never the less, for your/your attorney's record you might want to ask your attorney to request a duplicate copy at some point (no hurries...) ... which can wait even after you get your PP stamped. And yes...the card will be mailed to you by the service center. (your freind might be referrring to 551 stamp...which is temp evidence of permanent resdience...for travel overseas and work authorization which is what you get your PP stamped with...from the local INS office)

Dont panic!

I can appreciate the concerns but there is no need to panic.
With concurrent filing I have known of two cases where the I-485(AOS) was approved before the I-140 petition was physically approved. Yes, the I-485 cannot be approved unless the I-140--petition by your employer for an immigrant visa in your favor--is approved in principle; but since the I-140 and the I-485, however linked, may be with two different officers approval letters may be sent at different times.
Do not worry--the I-140 is for the employer's record; you need not even be given a copy of the petition or approval. The I-485 is your privilege and YOU HAVE SECURED THE APPROVAL!

Don't worry, I 485 was approved 8 moths ago, I have the physical card now with me for the past 7 months, my 140 in website, says that the case is still being processed.

One last question before I get on your nerves :D
My I-140 approval got lost because of the incompoetent HR at my school who are extremely unfriendly.

Will the I-485 be mailed to me directly?

I wish they do.

Your 485, will be mailed to you directly, that is the current procedure, I will not worry about the i40 at all, since you will have your 485 approval notice, you are done,
