Strange question

Very interesting to hear from both sides. Its also very frustrating to keep extending visas and other documents to stay 'legal'. Wait times, complications and uncertainty in all of these processes is not something I'd like to be dealing with for many years. And yes, most of H1 are hopeful of GC and they are getting less in salary, made to work longer hours and get fewer chances to progress in career. Sometimes a 'progress' in career means jeopardizing your LC, I140.

Many of us have to pay for our lawyer fee, DOL fee, USCIS fee all of which comes in thousands of after tax, hard earned, right out of our savings, dollars. Uncertainty in jobs has stopped me from buying a property. The list goes on and on, you do the math. I dont care about gc or citizenship, just freedom to be free.

Well if you say 'As an IT proff. how does it matter to me' than I would say it depends on what a person is sensitive to. I know few years back a women was thrown out of a train in Mumbai, people did see her from the train and did nothing, those were the people for whom it didn't matter, then there was one guy who saw her lying and he walked down to save her, for him it matters. I care for who represents us, who rules us, who we look at for things. It doesn't matter to you, it's your quality. Also I did not understand the logic infrastructure Chaos, is a sign of development. There is no development in Patna, isn't the infrastructure chaos increasing in those forgotten places. Why do you just talk Bangalore/Chennai/Mumbai. India is not just these 4-5 cities. India lives in other 99%. what's happening to that ? Until that progress, claims and beliefs of India progressing is all hollow. BTW India is not getting too many FDI's we are getting FIIs let me know if you want to know what difference they make

Thanks Guys....lot of inputs....lot of frustration...coming out....I like this and I am in the same boat. But no matter what ....we have decided to go back to India ....in few years.....it looks like US life is not for me.....this stress..these visa regulations...these comparisions.....etc...

Does we need all these in our life to be happy...just confused more....

Go ahead and vomit your thoughts....

OK...after GC then comes Citizenship....another race.....

dan you said 'going back to India' but then you said '....after few years....'. Believe me I know 100s of Indians in this country, they will say they are going back, they want to go back bla bla. But I bet these are the last ones that will go. If somebody wants to go they'll go, they don't tell stories. Those are different material of people. My elder brother went back after living here for 3-4 years. He never applied for GC never ventured on these websites, and discussion on GC was just a waste of time for him, he was clear on his plans from day 1. Other than him I have seen all fakes!!! hypochrates!!!! one of those is Alhindi, he lives here and sings for India, now what is the logic of him being in this country and on this websites, only he can tell, but I'm confused. And my suggestion to you is, make up your mind where do you want to live, where ever you live one should live happily. If you want to live here live here happily, don't sing both the tunes. If you want to go to India, don't let any regrets come to your mind, just leave!!! you'll be a happy man.

Isn't the employer filing for second or subsequent request for extension, exempt from additional $1500 or $700?

So I think it will just be the base filing fee of $190.00 (without a lawyer) for the employee"

No, I Do not think so,

The fee structure is as follows
$1500 + $500.00 Antifraud + $190 - for comanies with > 25 employees 0r
$750 + $500.00 Antifraud + $190 - for comanies with <= to 25 employees
I have never heard a chnage in this whether it is first time filing or extensions;

I will again check with the attorneys' anyway as you raised a point.

Can some one else confirm on this ?

further to add to my earlier point, most of the employers are not reaady to pay for extension of H1 since the fees is too high.
So this is a burden on the empployee anyways.

Thanks

naudurivsm,

1. Antifraud fee of $500: is required only if you are changing employer or applying for H1 for the first time thru this employer. If u r with the same employer (as is the case here) and applying for extension, then you are exempt from this fee.
(As per Page 4 of Instructions doc.)

2. Data Collection & Filing fee of $1500 or $700: Exempt if it is second or subsequent request of extension.
(As per Page 6 of Instructions for I129 document.)

I don't have a lawyer and this is my interpretation of the document. Please correct me if I am wrong...

neha_wal...i agree with you completely...and even i have the same question to Alhindi.....does'nt he has a life....some work to do.....what is he doing here?. i do not know why people who say that they are citizen or GC or people in india get into these debates.

Hi APermApplicant,

You got it right. the $1500 or $750 fee is payable for the first time if we change employers like I did and subsequently ( just to keep extending) with the same employer it is only $185.00 ( currently ) and in near future it would be $190.00.

The same is the case with Antifraud Fee of $500.00

Thanks for pointing out and correcting me.

At least this is a releif in terms of extension costs every year.

Best Regards,
