I wont the DV-2008. I have not received the second package yet, but my number is current in March 2008 (CP interview). On April 2007, I sent the DS-230 forms for me and my wife; we have been married since 1996. We have a child together (born in the US).

My wife and I had a misunderstanding on August 2007 and we went to one of those layers that offers "expedited divorces". We obtained the divorce decree in about 1 week (in the US) !!. However, we continued to live together and we re-married this January 2008 (in the US). I am planning to send a letter explaining the situation to KCC and attach both the divorce decree and the marriage certificate. My question is: is this enough ??. Do I have to send new DS-130 forms with the "new" marriage date to KCC or I can take the forms to the consulate interview ??

I really need fast help on this, thanks,

So let me get this straight, since you received your first NL, you have gotten divorced, and then remarried the same person? And all before your CP interview the following march? A lot can happen in a year! Not sure what to advise you though. I am sure some one will. Here’s hoping that you don’t have any more “misunderstandings” before your CP interview in march ….

Thanks for your answer. Yes, when I receive the NL, I sent the forms back to KCC for me and my wife (on April 2007). We divorced in August 2007 and re-married (same person) on January 2008. I know that this will complicate the interview at the consulate but this happen in real life !!!.

Therefore I wrote a letter to KCC and I will send both (divorce and re-marriage) proof. But again, is this enough or I have to send new DS-130 forms (for me and my wife ASAP ???.

it will complicate things because the consular officer may suspect that you got married again only for the immigration benefits.

Thanks LucyMo. That is also my thinking, it was an stupid decision to divorce my wife and complicate things like they are now. I am seriously thinking that maybe I should go alone to the interview. What is your advice ??. I am not re-married her for the inmigration benefits but because we realized that everything was a big mistake.

Since you guys had kids together, i think you'll be aight

having kids proves that they WERE in a bona fide marriage - that was their first marriage. Divorcing and then remarrying before going to the interview rings a bell about getting married just to get a green card.

For that reason I am thinking that I should go alone to the interview; in that way I could get my GC without problems. Later I can make the petition for my wife (I know that she would get a GC in around 5 years).

However, I do not have anything to hide. Everything was done sincerely so maybe I will go to the interview with her and take the risk.

Any feedback will be very welcome

I strongly believe you will be just fine since you are telling truth, what they think will not hinder what God wants to do for you and your wife.Let kcc know of this; then GO WITH THE LOVE OF YOUR LIFE. I hope you now know that it is not good to rush in matters that have serious consequencies:)
