strage RFE never seen before, what to submit

Hi Guys,

Please advise us what to send for this kind of rfe. we both work in two different places and have different addresses. Now INS is questining how is this possible that both are working in two different places and justity the reason behind this. How can I prove that we are wife and housbands. We submitted marriage certificate when filed for 485.


Besides that, INS asked of employement letter and Medical for spouse.

RFE is still in the mail, once I get it I can give exact information. My attorney told me what is the RFE for.

Well, it's a logical question to ask. Most husbands and wives live under the same roof. The INS wants to ensure that the marriage is bona-fide.

How long have you been married? What common ties do you have? Shared bank accounts? Credit cards? Leases or deeds on property? Shared ownership of automobiles? You may also want to explain why you live apart from each other.

No problem. Once you see the point of view of the inspector, you will know how to try and answer the question. Apart from the marriage certificate, what common ties do you have?
 
Oh, man!

I am in the same situation as you. My wife is a student in another state. My stupid lawyer has submited her case to CSC. Till now, I have not heard anything from INS yet. I think you probably need to submit some evidence to prove that you are married and to explain why you are seperated.
 
he manitains address in different state, but lives with me

beside marriage certificate and bank account, we have baby girl who is 6 months old.

my spouse gets pay stub generated where he lives.
Most of the times my housband works from home.

Do you think it is going to be a problem.
 
Even my wife is a student in the neighbouring state and we both gave the same address(my wife's address) as residence. Good thing is I'm listed on the apt lease and we have my wife's address on file with USPS and also my paystubs, my credit card bills goes to my wife's address.
 
Exact RFE details

1. name and location of employer, date you began employement.
2. Employement letter

3. The record reflects that you are working and living in State X and that your spouse is currently living and working in State Y. Please clarify.

What should I provide to clarify beside submitting Tax filing, marriage certificate, bank statement, baby birth certificate.

Please advise .
 
If you guyz have joint bank accounts send that, W-2 joint tax return. If either of you have the other one's billsbeing taken care of by you then present that.
Think about small small stuff. My husband and I have the same thing we live in different states. But we've kept our residential address for INS as one. Moreover we have joint accounts, we file taxes joint and my husbands name is on my lease so incase a question like that comes We can show all this information.
Another thing is if you guyz have the same address in your drivers license you can show that.
Copies of bank statements going to one address can be shown. Remember anything that can be used to substantiate that you are husband and wife.
