Hi, my name is Sarah.

I'm in the same situation as Steve_Rus, but the only difference is i'm still on a conditional greencard. At the time of my husbands death we had been married for 2 years and 3 months. Will I be forced to return to England (My home country) since i was still on a conditional residency? If I can stay in the US, what do I need to do? and what is the chance of me being able to stay here?

Thank you

Sarah

Hello! Sorry for your loss.
Do not stress out more then you should.
As a widow of US citizen (he was a USC, right? ) you are illegible to file for Removal the Conditions on Permanent Residence Based on Marriage by yourself, if you can prove you entered into marriage in a good faith. Since you already went to AOS interview before, you should know what documents you have to prove your marriage was in good faith and you can provide same copies when you file I-751.

You’ll be fine.
Good luck!

If you have a child, then your changes are 100%, if not – they are still very high, since you been married to him for more then two years.
Just file your paperwork promptly with a bunch of supporting evidence (join accounts, past utilities bills and est.) and you’ll be fine.
He wanted you to become US citizen one day, didn’t he? He petitioned I-130 for you and it got approved, was it?
So just because man is dead INS has no reasons to deport his widow or deny her application. Unless you have no job, no home and no future here in US and planning to go on welfare...
