Hello,

I will be talking to a human resource person who is not familiar with h1-b. Can someone please explain to me on steps towards filing h1-b. Does a company file for the paperwork first or it needs to extend the offer letter for employment and then start filing for h1-b. I appreciate any help.

Find the employer who can file H1 for you (if you are eligible for H1)
Send copy all your education certificates, exp letters, passport pages
Employer can hire lawyer and lawyer file the H1 petition with USCIS. Once USCIS approve the petition, lawyer/employer gets the H1 approval notice.
He sends you job offer letter with H1 approval notice and you go for H1 visa stamping

A lawyer told me today that the quota was alreay filled and that if you want to apply you can appy on April 1st, but if it gets approved you will be able to work after October, 2007. That is what she told me, I do not know if is true??
