Asking this for a friend.
Friend is a single mom in India with 10 year old son. She is planning on marrying a US Citizen.
US Citizen previously had 2 divorcees in the past ( the last divorce atleast 5 years ago).
Assuming US citizen files i130 for the friend and the step child:
1) If friend marries US citizen in India - would the processing time for conditional green card be around 6 months to 1 year for the friend and 10 months to 18 months for the step child?
2) If friend and child comes over to US on h1/l1 and marries in US after 2 months - will the processing time change for the step child? Is this even recommended or where there be challenges?
3) For step child's application - is biological father's permission needed?
4) Although friend has been separated for 3 years, she will get a formal divorce shortly. Would it be a red flag for immigration authorities if she marries a US citizen within a month of getting the divorce. Any recommendations?
