Now our next step is wait for “Mexico” to have a current or future date in “A. FINAL ACTION DATES FOR FAMILY-SPONSORED PREFERENCE CASES”. In order to file AOS?

Do you have an actual receipt notice with a priority date on it yet?
You can file for AOS when that priority date is current for the relevant month’s visa bulletin in Table B, dates for filing. This means that if the visa bulletin is for December, you have to wait till on or after 1 December to file.
Processing takes months/years -and he will not actually get an interview/green card until Table A is current. Until then, he needs to stay meticulously legal. If he’s on F1 status, follow what he needs to. If he rolls into adjustment pending, don’t work without EAD. Etc. if he violates status he cannot adjust.

Hi Susie,

we were able to file I-130 on November 21st before the bulletin date of nov 22. Now we are preparing the I-485 adjustment of status and the form has changed since I filled it out.

the form is really confusing, any advice on how to fill it?

part 2 question 4

part 9 question 58. do we put joint income even if we havent filled taxes together?
do I have to send I-864 with my Husbands AOS?

As a family-based immigrant, he would generally answer 1.f (None of these exemptions apply to me and I am not requesting an exemption as I am required to submit an Affidavit of Support Under Section 213A of the INA), unless he has accrued 40 Social Security credits.

part 9 question 58. do we put joint income even if we havent filled taxes together?
I believe so, if you guys are living together, since he is counted as part of your household size.

do I have to send I-864 with my Husbands AOS?
Yes (unless he has accrued 40 Social Security credits).

one question about I-864. in part 6 item 7 i put my income and if it is over the 125% guidelines, should i still add my husbands income in item 8? if yes, what should i answer in remarks? select item 14? as we dont have any children.
