Hi,

I am right now in India for more than 5 months. I have GC for 3 years. If I want to stay for 2 more months, how does this affect when I want to enter into US. Can I still apply for my citizenship after 5 Years time.
DO I need to apply for any extension If I want to stay in India for more than 6 months. Please help me. This is urgent. otherwise I have to enter US immediately.

Thanks
Krishna

read on www.ins.gov

for trips b/n 6 months & one year you disrupt your continuous residence unless you can prove to INS otherwise. My personal concern is how difficult that is (i don\'t know yet), would tax returns and maintaining US address be enough or not? If you cannot prove it then you lose all the time accrued before and you start all over once you are back.
but if you have a re-entry permit for absenses b/n 1 year and 2 years, 364 days of your stay abroad count towards your continuous residence, so infact you can apply 4 years and one day after you are back

regarding the extensions i am not sure what you mean
read on the web site above and may be that will help you decide

Stay outside US

If you are staying out of US for more than 1 year have to apply for reentry permit. But if you are staying leass than 1 year no need, but port of entry officer could reject your GC,unless you give a good reason why you stayed more than 6 months. If you have house mortage or phone connections, fine.

Thanks guys

Thanks for all your information.Looks like it is not possible to apply from abroad for re-entry permit. Any way I am coming back to US. Thanks for your help

Someone has to be outside US for less than 6 months in order to maintain his US residency.
How these 6 months would apply throughout 1 year?
Let say, i leave the US on october 30th 2005, so i'll be out of US for 2 months in 2005 and then i can still be outside US for another 6 months in year 2006.
Please shed some lights on this issue.

thanks

JoeF question for u!!!

I was out of country for 177 days and returned back. At the port of entry Office wrote on passport "Out for 6 months".
I have applied for Citizenship and waiting for interview anytime.
Will I have any issues with this?

Thanks,
