stay in US after layoff

Hi All,

A friend of mine was laid-off at the end of March this year. He is still in US trying for job. According to the company who laid him off told him that they would send notice to INS to terminate his H1B petition in early april & he has 60 days until early june to find another job.

Is it true that he can legally & safely stay in US for that long..

He becomes illegal following the last paycheck. Should transfer H1 ASAP. I have seen people getting H1 transfer approval after 2-3 months of layoff, but it depends.....on INS.
 
I used to be much easier to get a transfer after a month. As time progresses, the probability of approval drops off drastically. After 3 months of no paychecks the approval rate is probably near zero and if the old H-1 is cancelled then I would say "transfer" is virtually impossible.
