Hello Friends,

I have an unique problem. My I-485 has been filed through my wife's company & I work for a different company on H-1. As of now we are yet to receive our EAD,but we have receipts from CSC. My question is if I get laid off ( which seems imminent) do I go out of status or not? Should I have to get an H-4done through my wife company in that case to stay in status. Please reply.

If you have a 485 pending, then you need not go out of the country. You are fine. You are in 'AOS Pending' status. But you will need a AP (Advance Parole) to go out of the country and come back. You don't need to think about going into H4 status etc.
