Status Question....

Hi ,


I am a Green Card holder and my fiancé is a student here on F1. If I marry her, and file her GC petition, at what stage of her GC processing, can she discard her student visa? Also I assume there are a couple of steps the application should go through before we could file I-485…right?

Thanks for the post,￾@so it seems like as soon as a person, who is already in the country, receives receipt from INS for family based immigration filing, he or she can stay here in US but cannot leave and come back to the country￾cis my remark correct?

Your fiance being on an F-1 visa needs to maintain her own immigration status. she cannot derive a status from her LPR husband till her visa priority date becomes current which can take any where from 3-5 years.
