i am a mumbai cp case and am expecting interview in july/august. my company is planning to send me on H1 on an assignment. I am plannig to take my wife on H4. She is pregnant and if I take her she may not be allowed to fly back to Mumbai for the interview. I am planning to request the consulate to reschedule my wife's inteview. If I alone come to mumbai for interview and go back on Immigrant Visa, Will her H4 get cancelled (I have heard that once I get the IV, all my valid H1s,B1s will get cancelled with no prejudice) as it is dependent on H1?

Thanks

How about rescheduling the IV interview based on your wive's condition? Or delaying the H1 assignment?

I don't want to delay our IV interview. As it is more than 2 years ..and the skills i am having are less-in-demand (compared to what the demand was 2 years ago).

I guess postpoing to go to US now on H1 is the only good option in this context. Then once the IV interview is over than, I can go to US and my wife can join me later after the birth of the child.

guys if there is any other way which can be expediated..than do respond.. i got this good assignment after a long time (1.5 years+) and I fear, delaying it will be as good as loosing it.The client may not wait till july/august.

Thanks

If you get your CP approval and if your wife is in usa on h-4 then gets outof status effective the date of your cp approval.

Options:
1. Postpone interview to a date feasible (post delivery) for both of you to attend.
2. Both of you fly to india, you do your interview (postpone your wife's) while your wife delivers in india then attends her interview and returns to usa at a later date with child becoming GC holder

I have an approved H1.but not stamped on the Passport. When I first went to US with H1; I had applied for H1-Extn while in US. But that assignment got over and I came back to india. The H1-Extn is approved until 1st Qtr. of 2005.

There is no H4 as I got married after I came to India and after that I never went to US. Bad market/economy coupled with the demand of my skills further going down !!

Have you considered, if you the US consulate will entertain your request for H1/H4, when the IV interview is about couple of months away?

Kailash,

Just a suggestion. In view of your special circumstances, could you ask them to transfer your case to a nearby consulate, say Montreal.

Hmm!

I don't think so. Unless you show relation to a different place/country, you cannot transfer the case arbitraily.
