Status change from H1 back to H4 - Please advise

Hi,

This question is regarding my status, Initially I arrived to US on H4 status and then got my H1 approved and worked for almost a year, I am still within the H limit, but due to my personal decision I am planning to stop working and change my status back to H4. I already resigned my job last friday.

Is there going to be a problem in converting back to H4 ? and How fast should I do it to avoid being out of status?

Your advise will help me get through this great confusion of status..

Thanks..

Thanks GotPR for your reply...

So you mean I can change my status to H4 even after not working for couple of months being on H1.

Only 1 H would be active at any time. H4 to H1 transfer would result in H4 becoming inactive. The only way to get back on H4 is to travel outside and come back on H4 if you have valid H4 visa.

Sorry, I missed the fact you already quit your job.
To be strict, you need to file COS before you quit your H1 job. As you already quit your job, you are out of status now and COS you file after being out of status may or may not be approved.
Quick and safer way is, as another post suggested, you travel and reenter the US with H4 visa if H4 stamp is still valid.
If you do not want to travel, you can try COS. You should file it as soon as possible.

My visa is not valid and what would be the option if any problem arises during COS ?

Thanks,

You need to travel, and get stamp and reenter , if you can not do COS.
