Hi

My opt ends on May, Iam waiting for the 20k to open up, otherwise will file for the 2006 qouta, with start date work on oct1.

What will be my status after may to oct.

Can I legally stay in Us after May.


What are my options to stay in leagl status from june to sept.

I guess, during and after OPT of one year, you are still under F1 status. However, after OPT expires, You must stop working until you get H1 status approved. If you are already graduated from the program, then you may have a problem. You better seek advice from attorney and University program director for international students from where you got F-1 or I-20

Attorney Murthy : Although the USCIS has not released any further information officially, today our Office learned that the USCIS will consider an applicant to be maintaining valid legal status if the USCIS accepts the person's filing under the 20,000 quota after the publication of an update in the Federal Register. So this is really good news for many who were nervous that their status may no longer be legal in the U.S. If the person's status expired on or after March 8, 2005, for example, or will expire before the publication of the USCIS update in the Federal Register, that person will be okay if the USCIS accepts the filing under the 20,000 H1B exemptions.
