What's the statue of limitation on marriage fraud done for immigration benefits? I am only talking about criminal prosecution, not revoking citizenship or revoking green card obtained via such a marriage.

State side - it varies from 2 - 10 years it depends which state you reside in.

Federal side - longer it depends when you presented those forged instruments to USCIS

I read that all immigration fraud has 10-year statue of limitation (I am only talking about criminal prosecution -- not deportation and revoking citizenship). Is this correct?

However, then I came across this case

where the marriage and submitted application appears to be older than 10 years.

Also, recently, I remember reading a case where the marriage occured in 1984. Huh? Why didn't the defense raise the question about statue of limitation.
