Starting gc process! Help with 3 questions please!!

My husband got his USC!!!! :D:D
I started filling out the forms for my GC and came across 3 questions:

- I don't have any status right now..actually since december last year I'm not a Visitor (B2 Visa) anymore...so what should I enter in the Current Status space? Should I put Visitor since that's the last status I had? or N/A? :confused:

- I have a job so what should I enter in the Occupation space since I shouldn't be working? N/A maybe??? :(

- My husband and I filed the 2007 tax return together. Now for the Affidavid of Support (I-864) he would need to send the tax return as one of the income proofs but since I'm also there it wouldn't be "appropiate". What can I do? :confused::confused:

PLEASE HELP! I REALLY NEED TO START THIS PROCESS SOON...

You are out of status and basically here illegally.

If you want to stay in the country I suggest that you get a very good immigration attorney.

i am filing for my husband in the same situation . he doesnt work though. in the current status section put "B2- out of status" . u do not need a lawyer. about the working situation just put n/a unless it is a taxed job. do u report it when u file ur taxes with ur husband ? if not u ok. if u do then u would need a lawyer.
 
You are out of status and basically here illegally.

If you want to stay in the country I suggest that you get a very good immigration attorney.

The point is she entered legally and she is the spouse of a USC therefor shes forgiven for overstaying and for working.

Just be sure not to lie. If you worked, dont hide it.

You do NOT have any status as of now. You should put there as 'Adjusting status' as to your Current status on the application.

You can put honestly what's truth, which about working. It's true that you shouldn't be working but it wouldn't hold against you at all because immigration laws automatically forgive someone for violating thest kinds of technical violation of immigration laws like working without USCIS permission, overstaying...etc.. whenever the beneficary on I-130 petition is the immediate relative of a US citizen, which is the case here because you are filing the application to adjust your status based on being the wife of a US citizen. Officer wouldn't even ask you anything on it, believe me. But make sure not to contradict yourself on all kinds of different forms. Some people write something on form G-325A but then write something else on other forms. It's better be truthful than lying especially when this won't hold against you.

Is your income there too? I mean, you were working in the last year as well and were married and filed tax return jointly with your husband, then obviously your name and other information would be there as well. Nothing to worry. But it's more important now to tell the truth on the application about your job than ever because now there is an evidence of your having worked. If you lie and USCIS finds out then your application will be denied..not because of the merit of your case but for you not being truthful on the application under penalty of perjury and under oath which is a ground in itself to deny the benefit regardless you are qualified for the benefit or not otherwise. Anything on the application is furnished under penalty of perjury. And each applicant is placed under Oath before an interview is conducted. And whenever AOS is denied, person is subject to deportation without a doubt. So just tell the truth about your working especially when it's not a problem at all.
 
THANK YOU ALL FOR YOUR QUICK AND HELPFULL REPLIES!! IF IT WOULDN'T BE FOR THIS FORUM I WOULD OF BEEN SO LOST IN THE IMMIGRATION WORLD MANY OTHER TIMES...I THINK THE HELP YOU GUYS GIVE IS SAVING MANY PEOPLE LIKE ME :)

I honestly was surprised that it is possible to "be honest" and not be in trouble later for that! I heard from a friend there is a special "Pardon"? is that something else I have to send with my forms? or just at the moment of the interview? :confused:

I'm really nervous about this and just wanted to be 100% sure it wont affect me later...

How long has your husband been out of status. I am kinda in the same situation but if we put no employment in the last 5 years, wouldn't it look suspisious?

What about taxes? if no taxes were paid or filed? could they ask for the tax papers at the interview or even before? Anybody had that kind of experience? i was talking to the lawyer and his advice was to mention no work as there was no ssn and no taxes filed etc. what should we do?
 
How long was your husband out of status. I am kinda in the same situation but if we put no employment in the last 5 years, would it look suspisious?

1) that post has been dead for over 1 month

2) you MUST NOT lie on the immigration forms, disclose your illegal employment and you should be fine for as long as you paid taxes.
