Starting a Consultancy!

Hello.
I got laid off 3 weeks back and I got H1B valid till the end of this month. In order to be in status I need to transfer my present H1b visa to another employer.
I am wondering if it is possible to make my friend who got a GC start a company and he sponsors to transfer my H1 to his company. I learn that in order for that company to tranfer my H1, then the company should be able to show that it can pay me. If I can get hold of a contract project which will be atleast a few months duration, then these funds can be used as my salary.

Can someone please tell me in detail as to what needs to be done, quick and fair. I am planning to consult a lawyer regarding this but before that i want to some insight also.

Anyone out there who did the same?

Thanks in advance for the help.

Hi,

Joe, my company will still be paying me till the end of this month. Even though my visa is valid till end of 2004, since they will be giving 2 more pay checks (layoff compensation etc) till end of feb '03, that will be the time I will go out of status.

I think that I can apply for tranfer of H1 to a new employer untill 30 days from the date I recieve the final paycheck (correct me if I am wrong).

Snt..., What you said is what I learnt today too. I talked to one consulting firm and they said that if I can find a project (with a company who is not willing to sponsor my H1) they would tranfer my H1 to their company and I can work on the project, but I dont need to pay for the visa tranfer costs. Ofcourse apart from the above meandering issues, they said that they will try to find a project for me and if they can find one, then it will be a straight forward process. I only wish that I could retain my previous job, where I was treated like a pet. :-)
