Starting a Business while in H1..

Probably, I'm the Nth person asking you the same question. However, I would appreciate your answers.

I intend starting a consulting business and an import/export business. Here are my questions.

1. Can I register myself as the Sole Proprietor of the Company?
2. How Do I appoint the CEO without signing the offer letter for the CEO, Do I get that done by my Attorney?
3. If I decide to wind-up (too premature to ask this). How do I realize the money, if there is any, into my account? Is that considered a dividend for my investment?
4. What other role that I can play in running the business without harming my status or my permanent residency application.
5. Once Myself and My wife gets EAD, can I choose to be in H1 and my wife invoke EAD to be the new CEO and manage business by ourselves?

Is it possible to switch from an LLC to INC? If so, what do I have to do. Any web links with details are much appreciated.

Wanted to ask you more questions.

1. Is it possible to file for H1B visas, immediately after starting the company. Or do I have to provide Income proof (which is not possible as its going to be an infant company)
2. Since I'll be one of the partners of the LLC. Is it possible that I can get my or my Wife's H1B processed through this newly formed company and start working for it?

I thought one cannot have any sort of second income while on H1 and working full time for a company sponsoring that H1 !

Have I been wrong all this time? I wanted to do something consulting business on the side !
 
If you are one of the Partners of the LLC then you will have to pay self employment income on the income that flows in to your personal from LLC- flow through entity, which is not very advisable when you are in the process of GC.

You need to give a second thought of electing to be a Corp.
