stamping in canada - expert opinion needed

Hi,

I moved from a student visa (stamp valid toll 2004) to a H1-B visa. I am planning to go to Canada to get my stamping next month.

I plan to fly to Canada, I understand I need to surrender my I-94's - the one that is with my passport and the one with my H1-B.

1. Is that right?
2. If I am refused a H1B stamping, can I come back to the US - my student visa is valid till 2004? What papers should I show to the immigration officer then?

Totally confused right now....

Any experts around to help?

Your F1 is no longer valid

You applied for changing status from F1 to H1 and with the approval of H1 your F1 is no longer valid (OPT is a different animal, but it does not help you to travel, so it is out of this discussion)

1. yes, you have to submit the I94s, you can give F1 i94 and retain h1 I94 ...

2. However, Per April 2002 Ruling, if a stamp is refused (They will not reject it...) then you cannot enter using any other previously valid I94... You will have to most probably travel to home country to get the stamp.

But if you are a US degree holder and have all the documentation required your visa is not likely to be refused. Getting the appointment is the only hurdle...
