1) My H1 expired on 24th August 2002. My wife came here on H4, got converted to H1 and worked for a year. Now she is not working. We applied for her H1-H4 conversion.

2) My H1 extension got approved yesterday. We need to visit India ASAP. Can we (my wife and myself) travel to India and get our passports stamped at US consulate in India with out my wife's H1-H4 conversion approval. Note that her passport was not stamped with H1 when H4-H1 happened. Also note that she will be coming back to USA on H4.

Please let me know.

yes U can. The h1 to h4 will be abandoned by travel. If she gets the h4 visa stamp then it does not matter...

When we go to India and apply for the visa stamping,

1) what are the chances that my wife's H4 visa will be rejected as she had a change of status in US.

2) Also do i mention any where whether she had changed her status when we go for stamping?

3) Or do you suggest that we try to get stamping from USA before we travel?

4) For getting the passport stamped in USA, where should we send the passports? and how long it may take?

Please provide answers.

Thanks for the reply. Request a clarification.

1. My wife's H1-H4 conversion is currently pending with INS. If i travel to India after that conversion comes through, then are the chances of getting visa stamped in india is 100%?

2. If we have to travel to India before the conversion comes through, are you advising to go to canada and get stamped before going to India?
