Stale Case Status Information

My I-485 application has been pending. I never received any receipt notice although I know the LIN number from the cashed cheque. The case status on the web and IVR shows a receipt notice was mailed in March 03.

Our H1 and H4 applications for extension was also applied and it has been a week since they were approved. Surprisingly the case status for both H1 and H4, on the web as well as IVR, still says a receipt notice was mailed.

I now get a feeling that the web and IVR do not access the master database that BCIS works with. It may be separately maintained, i.e., the BCIS officer or some one needs to mark the status in this database separately from the master database that they work with. And it may be possible that they once in a while forget/ignore to update it.

Now I am getting worried about my 485 application. I have not received finger printing notice although many others, I know of, in the same time frame have received their FP notices. The only good thing has been that the EAD for my wife has been approved that was filed alongwith her 485, 2 months after my 485 was filed. Hopefully they would not have approved her EAD unless they verified that the primary 485 application (mine) did exist in their records.

I am wondering if there is a cause for concern here. Only thing that worries me is whether they did issue the FP notice for me and never bothered to update the case status database (like our H1 and H4) and somehow their notices have not been reaching me (like the 485 receipt notice).
 
I would recommend writting a status enquiry letter to BCIS NSC ASAP. We had similar thing in our case. There was no sign of primary applicant's plastic EAD - in fact online status said LIN number not found although we had recd. the reciept notice as well as approval notice. Dependent applcant recd. the actual EAD in no time. Wrote a letter with a copy of the approval notice as well as explaining that online status says not found.

You can do the same .... show them the information u have thru' check clearence....LIN number, cleared checks.
 
Fingerprints are valid for 15 months. BCIS currently estimates that the average I-485 EB case will take 24 months to adjudicate. They may be deliberately delaying your fingerprint application to ensure you only have to do it once (many of us had to do it 2 times). You may want to wait a couple of months and then launch an inquiry if you haven't received a FP appointment.

I too never received any receipts from INS. In fact all my correspondence from INS goes to my lawer, expect for EAD card. I do not know why it is so. Of course my FP EAD and AP are all done in time.

Why donot you check with your lawer!

I will get started on some investigation into this with my lawyer.

Non-issuance of FP would perhaps have not mattered much at this point (only 6 months). But there is always this feeling that if there is a problem it might get out of hand later.
