Social security Supplementary Income(SSI) & SSP benefit received who is looking for I-485 application through Asylum

My mother has asylum status. She is over 66 and he has been receiving SSI benefit and Medicare from Social security as she is disable. Before that she had received Cash aid and other medical benefit from county as well.

Now, next week she will be eligible for adjustment of status through asylum. is there would be any fundamental reason for denial for her application because of above circumstances? or do they hold her application (held or pending). I am undecided whether I apply her application or not? Any one has been gone in same situation, your advise will be greatly appreciated. Nepz06

As an asylee receiving SSI or any form of welfare will have no negative impact on her ability to get a green card. Relax and apply.

Also, the USCIS understands that the application fee can be very burdensome on someone on SSI. If your mom has trouble paying the fee, you can ask the USCIS to waive the application fee for her. I cannot promise you 100% but the USCIS has been very good on this. Please write on the envelope in bold letters KAPLAN. Then attach a letter saying that she a member of the Kaplan class and ask that her fee be waived. Include her detailed financial information.

Second, if six months after the submission of the I-485 she has not been approved for her green card please contact the USCIS and they will expedite her case.
 
you need to send copies of tax return with FEE waiver form.

once you file fee waiver, you must send copies of tax return of last year. just sending copies of benefits won't be enough to qualify for fee waiver. that has happened to someone I helped.

so send last yeat's tax return or your whole application will arrive back to you for refiling.

Tax preparer told me that it's not necessary to file tax return as she never work. I did not file the tax for her. What to do now?
 
she is an old woman so there maybe somehting to prove her inability to pay but in my case, when i filed for someone, we included foodstamp document to prove his inablity to pay including the fee waiver application filled, USCIS returned the package with denial and asked to send income tax document. he did not have so, we paid the fee and refiled application. so generaly, the thing they ask if u ask for fee waiver is INCOME tax return.

prepare a notarized letter to explain her financial situation. Give details regarding all her income, including support she gets from you and other family members (if any), all her expenses and all her assets. Attach evidence to your letter (SSI payment stubs, bank account statements, rent checks, utility bills, medical bills etc). Note in her letter that she does not have to file tax returns.

And, this is important, note prominently in her letter that she is a member of the Kaplan settlement class.

'Thankful' thank you so much for your informative details I did not know about Kaplan settlement class before. But now I have much information. Last thing, how I can do 'notarized' her letter which I have to prepare myself as she can't read and write? Again thanks to all who are helping me with valuable information.
 
i did send the bank account, the foot stamp recipts and bills, but still got denied and asked to send tax document.
