SPRINT-NEXTEL Mergers Of Equal????

All,
Is Sprint-Nextel merger of equal going to make the I-140/I-485 process for employees of either companies more difficult???? I am concern about the fact that BCIS might ask us to reapply for I-140…Please note that these companies are talking about a merger of equal and not one Acquiring another one. Please respond if you work for any of the two companies mentioned above or have experinced the same issue.

With USCIS, merger works same as acquisition. This kind of situation usually needs an amended I-140 not the new one.
But with AC-21 the requirement of amending I-140 has lost its meaning unless you get an RFE for I-140 for company financial.

Thanks Tammy2 for your prompt response! Correct me if I am wrong, you ment that unless I get an RFE, I am in a good shape and I should go along with process. So basically, worse case senario is an RFE that I have to go through...

This amending I-140 is required if you have not yet applied for I-485. In case if you have already applied I-485 wait until I-140 get approved and 180 days of I-485. Once you qualify for AC-21 you are fine.

Amending I-140 is pain. Again they will go through all company info. But if they ask you company 's financial info in during your I-140 you do not have choice other then amending the I-140.
