Here is my situation. I have L1-B visa which is expiring on Dec 20th 2009. My wife is working on L2 EAD which is also expiring on Dec 20th and she needs to apply for EAD renewal by Aug 20th(120 days before expiry).
My current company is trying to do a L1B to L1-A conversion as i already completed 4 years on L1-B.My wife is going for a home country trip for 2 weeks(Jul 18th to Aug 3rd).
Below are my questions:
1)Can my wife travel to india after my L1b to L1 A conversion is applied.What kind of issues will be there if she travels while my application is processing.
2)Is it better to Apply for my L1b to L1 A after she comes back to USA?
3) if the Premium processing option is avaliable can i apply for L1B to L1A conversion and get the approval before she leaves for her trip. In that case does she needs a stamping in home country or can she come back using her current valid L2 visa stamping(expiring on Dec 20th).
4)Will there be any possible issues with L1B to L1A conversion? I have been working this company from more than 8 years and working in USA on L1-B from 4 years.
5)what happens in case my L1B to L1-A conversion is rejected.Will i still be allowed to stay still my L1-B visa expires(Dec 20th,2009) or do i have to leave the country soon.
Please suggest me the best way to handle this situation.
