SPOUSE ON H1 --> I 485 Filing

Hi Guys,

I and my wife are on H1B Visa.I applied for Green Card.I cleared I 140.
Now At I 485 STAGE ,Do I need to furnish my wife\'s tax returns,pay stubs because she is on H1B Visa.We got our medical and birth certificates.
I am applying I 485 next month, please help me what all documents I need
for I 485 PROCESSING in Nebrasaka Office.

I don\'t think you need to provide your wife\'s paystubs
because she is not the primary applicants. But I think
she also need to submit copies last three years tax
returns, if you couple do not file jointly.

To the best of my memmery, we submited the following
(both applicants unless other else noted)

(1) I485 form
(2) FP form
(3) EAD application
(4) Advance parole applications
(5) Biographic forms
(6) copies of curreent passports and old expires ones
    (all pages from cover to back)
(7) Brith certificate and translation with authentification
(8) Marriage certificate and translation with authentification
(9) Affidavit by primary applicant to support the spouse
    with notization
(10)bank statement
(11)tax returnes for the past three years
(12)three recent paystubs for primary applicants
(13) immigration history summary
(14) most recent I94
(15) citation and court dismissal disposition document for all
     brushes with laws
(16) medical exams

Yes, I think you need. I just filed I485 this month for both my wife and me. My lawyer asked us to provide all those for both of us, She is H1b.

INS can ask for a copy of the last three years\' tax returns. But, you are not supposed to send them to INS while filing for I485 by default, only when INS asks for them.
