Hi everybody,
Here is my situation: I am an asylee from Country A, I got married here in US with the citizen of country B, who got asylee status as my spouse later on.(filled relative petition) Practically he never applied for the asylum from his country but he is asylee. Right now, he desperately needs to go to his country and my question is if it's ok and he won't have any problems entering US with the RTP.
Thank you.

Your spouse will be fine. First of all, he is a derivative asylee, so he is OK. Second, your asylum is based on country A, so going to country B is not an issue (not even for you).

Thank you

Thank you, I spoke to the supervisor blah-blah from Immigration, who told me thet in Theory he won't have any problems, but practically may have them at the border of United States after arrival.
And another question what passports should he show when leaving country B-RTP and NP together?
Thank you.

Anybody can refer me to somebody or something who knows for sure.

Hi, I have to pull this topic again.
I talked to immigration officer in Federal Plaza about my husband's travel issue. He gathered other 4 officers, they discussed it for 10 minutes and then they came up with the desicion that if my husband is asylee -he cannot travel to the country of his citizenship. I tried to argue, i asked something written that would support their words, they didin't want talk to me. I am totallly desperate for the correct answer. I am in search for three years already.I sent letters to USCIS, I talked to officers, I talked over the phone, I wrote to Senator.NOTHING, no responce, looks like nobody knows. And he really-really needs to go to his country.

iam almost the same situation like you,

i was asylee my self from middle eatern country, i got married here, my wife is from asian country, she got derivate asylee as asylee spouse,

each time she used to travel to her country she used her national passport,

and when she came back to USA she used RTD, she never have any problem

last year she got her GC, she stopped using RTD, She use NP FOR GOING AND COMING.

good luck

Thabk You. I hope we get same luck as your wife. My husband allways gets through the secondary check pointe and allways gets asked if he went to his country of citizenship. i don't know, maybe JFK has only such jerks.

I really don't understand why you worry so much. Your husband is a derivative asylee, and not a principal. He should have no problem returning to his country. Moreover, his country is different from your COP. This also makes him more safer to travel and come back to US. Don't understand why he would need to go through secondary inspection at POE. Anyway, I think there is no ground at all that your husband should be feared to go to travel.

Thank You

Thank You everybody for your support!!! We will go on our trip in May. I'll let you know what happened after.

Also see Wantmygcnow's experience coming back from Germany called "Black and white answer". that should make you feel much more comfortable that your hubby would be just fine. I hope you'll run into a nice I/O and not a jerk. Try to avoid JFK and Dallas.
we'll wait to see your post which hopefully be called, "My hubby just came back safe & sound" in May.
good luck.

Oh, thank you so much. But read "EXPERIENCE IN JFK" That makes me only uspet. The airways I fly has only flights from JFK, don't have choice.

If you have such dread about JFK, you CAN use another airlines by making connecting flights. It may not be a direct flight as it woudl have been from JFK, but you may still go to your destination by making connecting flights and using, say, Newark Airport instead.

We are back!!!

WE just got back from COP of my husband. Got back to JFK, and it was WONDERFUL!!!! The officer was extremely nice, was joking with our children, we went to Secondary Check Room, but the officer said SOrry 100 times. In 5 minutes we were out of there without any questions at all. I couldn't believe it!!! We are so happy.
Thanks everybody for your support and help.
