I've filed I485 following my husband for a year. This fall, I will go to attend a university in another city, so I have to move there. But my husband won't move with me because he can't find a job there. So we will live in different places for a while, which has about 4 hour driving distance. I will stay with my husband on weekends and then go back to school. Shall I report the change of my address? Will it cause any trouble for my GR application, since we will use different address in our application? Thanks.
 
After I move to the city of my school, if I report the change of my address, then my husband and I will have the different address. If I don't report my change, isn't it regarded as a fraud?
 
If you think that the university addresss is your permanent address and you want to use that on the application, then you need to inform BCIS about the change.

Otherwise the most logical option will be maintain your husband's address as the permanent address. You can treat the university address as temporary, since you go back there as home on weekends anyway. Most probably will be filing joint taxes using that address too. In that case you dont need to inform BCIS and there is no fraud intended this way.

Thanks a lot for your reply. I'm sorry that I didn't make my situation clear. Actually, my husband will move to a smaller apartment after I move to my school. My name won't be signed on my husband's new apartment's lease agreement, so even though I stay there on weekends which might be against the lease agreement itself, I can't approve to INS that I live there.

My worry is that if my husband and I change our address at the same time, and our new addressed are different, will it make INS have the doubt that we have some problem in our marriage? If so, how can we approve it is not the truth? Thanks.

By the way, we have been married for 5 years, before our green card application begun.

Can you provide some more details :
a) What is your husband's status ?
b) Where have you fillied the application ?
c) If you are moving to a different state then your application needs to be transferred if you show the new address ?
d) Is there any problem in getting your name on your husband's apt lease ?

Here is the answer to your questions:

1. My husband is in H1B status now. I'm the dependent one in our GC application. We have filed our I485 for one year, and have already done the fingerprint.

2. We applied our GC in Washington DC.

3. I will move to a city in New Jersey and close to New York City. Both New Jersey and Washington DC shall belong to Vermont Center, right?

4. My husband will rent an efficiency, a kind of apartment which officially only allows one resident. So my name won't show up in the lease agreement, but it shall be ok if I spend the weekends there.

5. My husband won't move with me just because of our GC application. Under current economic situation, he can't find a job nearly my school in a short time. If he is out of job when we are requested for employment evidence by INS, we will be rejected GC.

my friend is also in the similar situation. Lives in DC and works in NJ. They are maintaining DC address.

Since your husband is the main applicant and you are the derivative, It will be advisable to call BCIS and provide them the new efficiency apt address. They dont care whether your name is on the lease or not. He can always put your name on the telephone bill or utility bill. Plus you can still get your credit card bill over there. As long as you maintain the driving license under the new eff apt address, you will be fine.

Dont show different address for you and your spouse, which is technically possible but creates too many confusions. The less the better....

I am in a similar situation

This thread is very helpful as I have a similar situation. My USC spouse will maintain our home in the city where we filed for my AOS while I plan to attend a full-time program out of state (a few hours by flight). I plan to return to our home area after the program. Here are some questions I have and any insight is appreciated.

- Is it true that I don't have to file a change of address form for immigration purposes? If so, do I still need to file the change of address form for all non USC?

- Although we are living together, my name does not show up on any utilities bill or the home ownership document since my spouse established our current home a few years before our marriage and we intended to keep the current status. My driver's license and other mail do show that I live in the same address as my spouse's. Would that be sufficient?

- If we go to the AOS interview later and the interviewer asked whether we are currently living together, should we answer yes or no? If we say yes (or no) and proceed with an explanation of the current situation, would that raise any problems with my AOS application?
