Spouse & Kids Approved- I'm Still waiting HELP

Hi All

This forum has been great. I have managed to keep some sanity by reading through the site and getting everybody’s updates.

I now need some knowledgeable advice.

Thankfully my spouse and kids (dependents) have finally received their 485 AOS approvals. Approved on 08/16/04 letter received in the mail 08/18/04.

But my case (primary) has still not yet been approved. The web site shows “results of your FP Received….”

I called the NSC 800 number and they took down my information and said they would get back to me in a month. My lawyer also said I should just wait. This is driving me crazy.

If anybody has any advice or has been through a similar situation please let me know.

Thanks

Details of my case are as follows

PD Oct 1999
140/485 RD Sept 2002
1st FP Oct 2002
2nd FD July 2002
Spouse and Kids Approved 08/16/04
I’m Still Waiting

LUD
Oct 02 FP notice Sent
Then no change till 07/20/04 FP results received (spouse & mine)
08/17/04 Spouse and kids message changed to approved
08/17/04 my LUD changed but no status change message still the same FP received

808_waiting,
This is really strange..., all these days I thought and also read in these forums that I-485 for dependents would be approved if and only if primary is approved. Have patience..., USCIS has no protocols to follow..., with USCIS anything can happen anytime..

all we could suggest is you call the 800 number and explain your situation clearly which you have already done.

It would not cause any harm if you try once a week to call them and explain. I did that when my wife got the card and I did not (I still have not received it yet and I am hoping that I will get it soon.), the second time I called the customer rep. was gracious enough to put me through an immigration officer (as he called that person - though I am not sure) and all I got from him was that everything in the case looks clear, it is just taking time due to administrative delays and I should have it in the next month.

So if luck is on your side, based on my experience you might also be put in touch with the so-called immigration officer and if you explain to him with all the receipt WAC numbers and A# number and that your wife and children who are derivatives are through while you the primary applicant is still waiting with no idea of what could be the problem, it might help them in taking a look at your case and may be things will move to the logical conclusion. Don't forget to mention that the current processing date as per JIT is way in the future compared to your case date.

Good Luck
