Spouse has pending appeal with BIA

Hello!
Boyfriend was detained by ICE in Aug 2007( he was working illegally, claiming he was USC). I( I'm a USC) got him out on bond, and married him in Dec 2007.. I submitted I-130 in Dec 2007. I130 is still pending.. Have not received appointment for interview.. Spouse was order to be removed by immigration judge in July 2010.. Husband's attorney sent appeal( motion to reconsider) to Board of Immigration Appeals in Aug 2010. Spouse obtained work permit in November 2010, but abandoned our house in February 2011.. I've been told I can't contact The BIA to advice them that he has abandoned me.. I've already submitted withdrawl letter for I130. I'm in the process of obtaining divorce.. He has a USC son from 1st marriage.. What are the chances he will obtain green card?? I feel used...
 
Have you received an acknowledgement of the withdrawal? That will end any basis for a visa and the motion will be denied and the removal order will stand up to any challenge.
 
No, I have not received an acknowledgement letter for the withdrawal of the I-130. I was also told that my husband's attorney can submit an EOIR-42b wich could be granted by the judge.. Is this true?
