Hi,

I came to US as a spouse of an US citizen, my green card is valid for two year and has not yet expired. My husband divorced me to marry another girl so I do not have any petitioner or waiver to remove my conditional resident status.

I'll get married to another US citizen, my question is:

DO I HAVE TO COME BACK TO MY COUNTRY TO APPLY A NEW IMMIGATION VISA? OR CAN I DO IT IN THE US?

First, YOU DON"T NEED ANOTHER PERSON TO SPONSOR. YOU CAN BE SOLE APPLICATION FOR YOUR 10 YEAR GC, BUT BE SURE TO GET THE DIVORCE COMPLETED ASAP and NOTICE USCIS. There is a law for that I heard on that repeatedly on radio from many Vietnamese/Chinese lawyers. Vietnamese/Chinese people do that A LOT and no problems.
Consult with good lawyer (who does that kind of cases), they will help you.

But if you marry because of love, then wait for 10years GC first. If not, it will complicate your case since USCIS MAY DENY your case because of fraud (they might think that way). You have to prove for LOVE.
