Spouse Case Waiting ?

Hi srichalam,

What is the status of the your spouse's H4 R H1 ?

I thought WOM is gone and is no more an acceptable way to get to FBI ?

Well as I updated in this forum both the caes where filed simultaneously [ which is obvious in majority of the cases ] - not sure why only the spouse case becomes PENDING if primary applicant gets cleared - strange but true.

My I-485 application is approved today but my wife's case is till pending. Just an LUD on her case 03/21/2007.

For deriving into a pattern; can you provide your wife's filing status ; H1-H4 and did you check if FBI NAME CHECK is pending for her case ?

She was on H-4 and now EAD.

Both the cases had LUD at the same time. I didn't call FBI or USCIS till date. I will wait for a week or so and then call.
 
Congrats ! :) Aj1971; Looks like the FBI god had answered your prayer already it was just a matter of the e-world sending the message.

Last time I checked and even called the FBI # even now; looks like the automated message says nothing much [ basically don't call this number ] and the email as far as my understanding goes is stopped and no encourage at all.
So on the FBI website too they are saying for any kind of status inquiry go thru USCIS which mean again a runaround.

Any thoughts ???? apart from sitting tight :mad:

Spouse was on H1 and now on EAD.
 
Did you have any kind of inquiry going for your spouse too while you had placed yours ?

It's kinda continuous process. I wrote to Ombudsman a month ago, and they forwarded my letter to Customer Support Office, USCIS in D.C, and i got a letter from them couple of days ago, that my spouse case is pending due to background check and if i didn't hear anything from USCIS in six months, contact their 1800 number. Sadly, they didn't talk about the copy of the FBI email that i attached with my letter. Bottomline, they don't give a damn what we got. They only care what they got.

Not sure even WOM help us in this scenario.

Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: We mailed you a notice requesting additional evidence.

On March 27, 2007, we mailed a notice requesting additional evidence and/or information in this case. Please follow the instructions on the notice to submit the evidence and/or information requested. This case will be held in suspense until we either receive the evidence or the opportunity to submit it expires. Once you submit the information and/or evidence requested, you will be notified by mail when a decision is made, or if the office needs something further from you. If you move while this case is pending, call customer service.

Question is what could this be???

Did you check with your attorney as what the RFE is about ? or did you get a chance to call VSC.

All RFE at this stage is bio-metrics oriented as far as I gather with cases in the past.

But again VSC sometimes is turning picky; but the only lucky part in all this ordeal is it is still in VSC not gone to TSC.

But again VSC sometimes is turning picky; but the only lucky part in all this ordeal is it is still in VSC not gone to TSC.

why the VSC is better............. TSC far ahead than VSC. in my opinion.....

Status says they mailed the RFE request on 27th. So it will take around two weeks to make it to our lawyer. So I will have to check in 10 days to know what exactly is the RFE about. Will keep you posted once I know.

Here my take at looking at immigration as a whole and this should complete all types of issues faced by everyone floating in the same boat.

BAGUSAC: From my perspective of being lucky that your case is in VSC is
a) Transfer to TSC is always a new can of worm; PD dates consideration becomes in bulk because of the sister processing moved in - so can expect backlog which can a hellish experience then the one already that we are in.
b) VSC is bound to get the pressure to get it done as the idea a bi-specialization is zoning or only certain forms - Which means all pending cases should be cleared and ASAP.
c) I can understand the frustration vented on the delay; but I would say look at it 1/2 FULL - Meaning the changes of it being picked is thinner at VSC then the big crowd and the push now in TSC for I-485's. Given that I would say - staying within VSC is winning 1/2 the battle; obviously the card is the trophy but being unable to force through ; I guess inching should be ok.

guys any updates on spouse case...

after many calls i was able raise a case status referral today on my spouse case...earlier they were reluctant to take a case status referral also...today a nice guy in help desk took all details and said wait for 30 days...

As updated earlier; I have 2 case inquiries initiated already from my side got the same standard reply stating to wait for 45 days [ NOT 30 now I guess ].
So these inquiries where initiated within a span of 30+ days are so going with the old timeliness.

Not heard back from them ; no RFE's too so far; last update FBI namecheck is still pending for the spouse.

Now hot the applications got separated is a different question altogether.

Keeping fingers crossed as it is really impossible to predict or stipulate a rule for the processing patterns at the big office :(

We got mail from our lawyer about the RFE they recieved for my wife's 485 application. Here is the content ---

"A completed medical report (Form I-693) was not included with your application as required for processing or the medical report submitted was not signed by a civil surgeon designated by this service. Submit a medical report on Form I-693 signed by a designated civil surgeon. If you are not familiar with the civil sergeons designated for this exam by the Immigration and Naturalization Service, you may contact your local district office for a list of designated civil surgeons in your area. Further, you must submit a Supplimental Form to I-693, also completed and signed by a designated civil surgeon, to establish that you are current for all recommended age-specific immunization or that you have recieved a waiver of that requirement in accordance with Secsion 212(g) of the Act. Please note that both forms must be original and be returned to this Service in an unopened envelop that has been sealed by your examining physician"

Now the question is "Does she has to go through all the tests and immunizations all over again?"

Also any idea if your Spouse's NC is cleared - basically is this kinda check done after the NC are before the NC ??

Yes, this is a second request. We did all requirements together when we applied for 485 and my case was approved on 03/24. I tried contacting congressman for NC status, they sent a letter saying we have to wait for 60 days as there is an RFE. I would assume NC is cleared as mine was cleared after about 2 yrs. I am reluctant to call VSC as I know they will not give any info because they sent the RFE just now. Will post any updates...
