Hey guys herte is my situation.
I am on J1 got everything I needed applied I-140 NIW - EB2 with NSC. As you all know abt NSC is king of delays kingdom, I ma not sure when its approval going to be. I applied I485 in recent windforce. I want to switch to H1 on expiration of J1.
Now my question:

Can spouse work on EAD while I am on H1? If so what happens on reject of I-140? Can spouse switch to H4? or if either one of us satrt using EAD means both of us are going to be out of status? (Invalidating H1)

Comments, suggestions are highly appreciated.

If you are on H1, better to wait until 140 approval before using EAD...no harm on spouse using EAD, because if ur 140 is denied, u can always re-sponsor his/her H4 since u are on H1. On the other hand, I am unclear about the repurcussions of using EAD while on J1. J1 is not dual-intent and so if you have already applied for 485 and recieved EAD, you are not technically on J1 anymore - but I am not sure on that.

J1 should work similar to F1. As long you don't use EAD you are in J1 status, but you can't enter the US or get a Visa stamp any more because you have shown immigration intent.

Thank you guys.
I am on J1 have't recieved EAD but ready to apply by end of december to obtain them before expiration of my J1. I may switch to H1 once my J1 expired but at the same time spouse may start working on EAD. I don't think applying for EAD terminates J1, but, if I start using it then it terminates my J1 status. I read some where in the forum that even I can use it to renew my Driverse licence but should't use for work.
